She still needs some sort of punishment. Maybe 6 months. Being drunk is not a legal defense for committing a crime, and getting shot by the people you are violating is not a punishment. Intent and prior history should be a factor, but again at 3X the legal limit there needs to be a lesson taught here.

But you're not quoting actual legislation or past similar occurrences, you're simply making up a scenario and deciding it would result in a way that would upset you. So, you're not contrasting the differences between the states, what you're truly doing contrasting your own projection of the differences between the states.

No, I'm telling you what would happen in California. I lived there for 21 years and doing anything with a gun will get you in trouble, big trouble. And I'm sorry for not posting the exaxt legislation, newspapers and TV news don't often quote the exact law that was broken.

And of course, that's filtered through your own personal opinion on the state and it's legislation/view on guns in general. This same scenario actually happened to a kid I went to law school with. My third year of law school, he was really drunk and got dropped off at his apartment complex by some of his law school buddies. He'd always leave the sliding glass door to his apartment unlocked. Apparently, this night, he went in the wrong apartment which just happened to have a sliding glass door unlocked and the guy who lived their shot him in the head and killed him. No prosecution was possible because of the castle doctrine. It was a tragedy. Just wish he got dropped off one building over. Or that the guy locked his door.

Can't blame home-owners though. They've got to be terrified because someone is in their house in the middle of the night.

I hope they drop the charges on this girl. Just give her a deferred agreement to keep it off her record.

For crying out loud, just read it like hyperbole. He may not mean it that way but it'll be a lot easier on your blood pressure. And for the record, he's generally correct. CA's version of castle law requires forceable entry AND great fear of bodily harm before you can use deadly force. Coupled with the generally anti-gun sentiment in the most populated counties in this state, it's a fair bet that the homeowners would be prosecuted. And sued.

On another note, does anybody beside me think calling a law the "Make my Day" law is problematic?

That's not the official name of the law is it? Probably a nickname. Here in Florida the Stand Your Ground law is nicknamed the "Wild Wild West Law" lol.
