Heres an article from the Globe about BC leaving the BE and how they had meetings with Miami and the ACC about expansion as early as 2000.

Wasnt the whole premise of the lawsuit that BC-Miami-ACC conspired to cripple the BE? Couldnt this have been used to show cause?

That is precisely what the BE claimed. Once we secured our BCS affiliation we were hard pressed to show how the concference was damaged in a tangible way. We still are in the BCS, we still have our bowl affiliations, and our TV contract.
