the fact of the matter is, smoking is nasty, but what the owner of a private establishment wants to do is his or her business

FDA To Regulate Electronic Cigarettes As Tobacco

By: MetroSource News

(Chicago, IL) -- Federal health officials say they'll be regulating electronic cigarettes as tobacco products.

The FDA made the announcement about the regulation after an appeals court ruling that says electronic cigarettes are not drugs or devices. They have nicotine and simulate smoking but without the odor and ash of regular cigarettes. The Campaign for Tobacco-Free Kids is expressing frustration over what appears to signal that the federal appeals court ruling won't be appealed. The FDA's website says a plan is on the drawing board to regulate electronic cigarettes and other products that don't go through a pre-market review.

I think eventually as smoking goes out of style it might be effectively banned, but I'm not sure if I could support a statute saying that you're not allowed to allow smoking in your own place of business.

Obviously this is wasteful spending if you're trying to increase tax revenue, there are simpler, more efficient methods.

But, if you're trying to develop tools for tracking individuals, and calling that info up when desired...

I get a kick out of watching those movies from the 50s, 60s and 70s where a ton of people smoked everywhere and anywhere in small office buildings. I guess if you're bothered by smoke at a bar, it's easy to turn around and walk out. But I can't imagine sitting in an office cubicle and your cubicle neighbors are all spewing clouds of smoke all day.
