I doubt he'd be charged in Texas. I don't think a grand jury would indict. And I'm pretty sure you'd be hard pressed to find a jury that would convict. And I am quite happy with that.

RE: Attempted murder?
When Willie Kirksey returned and a struggle ensued, that would constitute a life or death confrontation where deadly force would be justified. Hesitation could have resulted in the Guard's death (David Johnson) . David Johnson was protecting his own life. My only concern is that David Johnson needs to hone his marksmanship skills. (I put that in for Roberta)

I would think he'll be fine in bama too. But he'll still go through the hassle. No one should do any more to this guy than encourage him to get to the shooting range. (you beat me to it Sum)

RE: Attempted murder?
Since the article doesn't give any details as to what happened when he returned, I don't think anyone here can make a judgement. The guard may have said "I told you not to come back" and pulled his gun and shot him. That would be excessive force.

I also think the rules are different between a homeowner protecting his family and home and a rentacop hired to protect a piece of property.

I suspect he will be charged and found guilty of a lesser offense than attempted murder, but guilty nonetheless.

When will the black on black crime end??????03-nutkick

Skipping ahead to where cb4029 wants this thread to go....

I bet if that security guard was white, they would have been patting him on the back for shooting that unruly negro....

That ought to get things rolling.....

Trespassing on your property at 4 A.M. after being previously told to leave- in Texas that is pretty much "open season" for the Guard because there are lots of presumptions for acts that occur at night.
