The trial of "The Pirate"...
Can someone explain how we can try a case against a Somali pirate in the USA? What am I missing?

I really do not know, but as soon as the pirate came aboard the Mersk ship, and then the US Military ship, Bainbridge, was it (?), he was subject to our laws and also international law.

A few weeks ago, I looked at the international laws regarding piracy. Note that I say I looked at them, not that I understood them (I'm not a lawyer). But, I believe under international law, trying them in your home country when you catch a pirate is one of several options. Walking the plank is apparently out of favor.

He's gonna get death, no questions about it. That's seems to be the standard punishment for piracy these days. An example will be made though, just like the saddam trial.

He won't get death. He didn't kill anyone. I think he will be doing at least 20 in the Supermax though. After a couple of years there, he will wish he was one of his buddies on the lifeboat.

I think you hit on something here and that is the potential jury pool. Law abiding Texans would probably sentence him to death during his arraignment and execute him before lunch time. In California and NY a conviction would be a coin toss. You know the pirate is going to be a celebrity in either of those markets.

The headline never should have been "3 pirates killed and one captured." It should have said "Captain saved, 4 pirates dead." This country has a history of making our problems drag on and on when there's a quicker, easier and cheaper solution. The guy is a pirate, what rights does he have?
