Quote:In the situation with the $26,000, police seized the money because the driver could not give an adequate reason for having that much money. First, the driver said it was to buy a car, according to the police report. Then, he said it came from working at various jobs. The passenger said he had no clue about the money.

Those factors allowed police to take the money.

“If it’s way, way over and above what a normal person will carry, and if things don’t add up (on how it was acquired), we take the money,” said Lt. Art Barile, head of the sheriff department’s vice and narcotics unit and the Allen County Drug Task Force, a multiagency unit run out of the sheriff’s department.

So what we have here is a guy who says that he was going to purchase a car with the money and he got it from working a various jobs, but the officers say that's not an adequate reason. So they get to take the money. Also we have a situation where the police get to determine how much money is a reasonable to carry around.

But at least in the end we got a few drug dealers off the street right?

Quote:Though officers held the two men for a short time in squad cars, they were eventually released without charges, save for the driver receiving a citation for driving with a suspended license.

And the money? The police kept it.
Oops.

Apparently the burden of proof is on you to prove that you obtained the money legally, the police assume that the null hypothesis is that you are a drug lord. Better save all of your pay stubs and be ready to account for every dime you spend.

...and who the hell determines what that amount is, dipshit? You?

It would behoove some of these morons to pick up a damn copy of the Constitution and actually READ the damn thing from time to time.

I could understand taking the money and arresting them for something...but to take the money and not cite them for anything is UNBELIEVABLE. What ever happened to innocent until proven guilty? I see this going to court.

I posted this when it happened in my hometown. It's not "apparently" it's explicit.

What upset me the most is that so many people responded (with a malice grown from envy) that this was ok, and Mr. Ricks would have no problem producing receipts if the earnings were legit.

Yeah, it's not the first time I've seen this kind of garbage it's been going on for quite some time in many places. There is a town in Texas that made the news somewhat recently because they targeted out of state drivers and said they have to come to court at a later date to recover their property. Just a way to supplement the town's revenue. I just thought of posting this when I saw your other thread, DrTorch.

I guess the fourth amendment is just a guideline, and by guideline I mean toilet paper.

...and that's scary. People in this country have been systematically dumbed down in terms of our Constitution. I've driven around with 5 grand before and I have never had receipts or check stubs showing where I obtained it. What if I didn't want to use banks? What if I cashed my earnings and kept them in a safe at my home and paid for everything with money orders? Is that now illegal?

It's not illegal, it's just fair game for the feds.

Confiscations like this happen all the time down in the Rio Grande Valley of Texas. You get pulled over, and if you are Hispanic, your car WILL be searched. Anything over $2,000.00 and they confiscate it.

Sure some of the money is drug money.

And people do go to Court and prove the money is legit. The County does return the money, minus 10% for "administrative fees and legal expenses". Most often in the legit cases its produce brokers going to down to the Valley to buy a trailer full of produce and they bring cash with them.

This is new? The government has been stealing from the people since the dawn of time. It's usually called taxes, although sometimes they are called fines or fees. But no matter how you put it, we never get any value for our money...

It seems the prosecutors do. It looks like Obama can stop printing money since we're not allowed to carry it. This is BS.

Quote: Local prosecutors take the cases with smaller amounts of cash, from $1,000 to $4,000, according to Richards.

i had an email along these lines not that long ago. a Patrol man in that area pulled over what appeared to be a Highway work truck, with all the markings, for speeding. They guys had the orange vest on and everything driving it, they were hispanic. Turns out they were using it as a cover to smuggle drugs.

they went back to their homes in Texas, found literally Rooms stacked to the Ceiling with $100 bills. Millions and Millions worth of money, looked like something out of a movie.

why these guys were still doing it is beyond me, I think I'd take my profits and live large while I had the opportunity rather than risk it. Either way, its likely there are similar home/banks like this throughout Texas.

Hildalgo County and Cameron County are the worst. There are lawyers down there that specialize in confiscation and forfeiture cases.

And you look at Hidlago County, see how many Judges and Sheriffs have been convicted for taking Bribes from Drug Dealers.

case I was thinking of was Texas DOT fake trucks, they use other things like Fedex, UPS, Drink distributors, etc. Also Terrorist are known to be thinking of ways to hit us under this disguise....all of which have police on the look out and extra paranoid I guess.

If they were using a "cloned" TxDot truck, its easy to get caught. State of Texas owned trucks have license plates that say "Exempt" on them, (no letters.. just numbers on the plate) as well as a special inspection sticker. Someone driving a TxDot truck with regular Texas license plates is a dead giveaway.

You can damn well bet that this loot will be used to further the useless drug war. The cycle is endless. We praise this and yet fail to understand that our own polices are causing this to occur.05-stirthepot
