Lucky to live in Alaska
We all know by now that the daughter of Sarah Palin is 5 months pregnant at age 17. We also know that her future hubby(the couple is planning a shotgun wedding) was age 18 at the time they did the wild thing. Well..Well..In 15 states this young man would be a criminal today as well as a expectant father. He would also have to register as a sex offender. How stupid is it that because of an arbitrary "calendar date" that this guy would be a criminal in many states..Im glad this happened in Alaska and not in a state that would consider this a crime.
This country is full of silly ass arbitrary laws like this one. Prohibitions on consentual sex, drugs, and prostitution put forth by tightass politicians and right wingnuts are using the force of the state to HARM innocent people that have done NOTHING to hurt anyone. It speaks volumes that the US jails more people than China. NO...We dont live in a police state.

I beleive NC has one of those laws, but they do have an additional age difference clause in there. If one is under 18 and the other is over, as long as their ages are less 4 or 5 years apart then you can't be charged with Statutory rape. That makes so much more sense.

Its all really arbitrary. No matter what "date" you set as the limit, the state could put you in jail if you were 1min underage of that limit. Prohibition is the evil...not the voluntary interaction of people with each other.

Are you saying that it is OK for a 25 year old male to have consensual sex with a 12 year old female? That shouldn't be illegal?

Good question...That is the paradox. Just what is the age of consent? Id say it depends on cultural norms. IMO Id agree with you that in the US.. 25 on 12...today..is criminal.. For most of our history this would not be criminal. We have delayed the adulthood of our children through prohibition. We use the force of the state to prohibit kids from growing up sooner, through public education and the prohibition of work.

This stuff came up in the "should gays marry?" thread where it was argued that the government should legislate morals. I used the example of having an orgy with 16 year olds and was called a pedophile rapist.
We have a sliding scale of morality that varies from state to state. Why is it ok for men to go topless and not women? Why is prostitution legal in Nevada and not any place else? How come bigamy is outlawed (yet pretty much goes unenforced in at least one state)? Then there are things like abortion, the death penalty, legal driving age...etc.
If there's one thing I know it's that I can't figure it out.

No need...I see it eventually happening on its own...(Evolution not Revolution)..A voluntary society based on the the principles of non-aggression slowly evolve... Private property rights(including your body) become be the basis for all societal norms. Individuals freely enter into binding contracts with each other and agree to arbitration in the case of disagreements. The free market, operating without the constraints of government find brilliant ways to solve problems by responding to market signals. Those that choose to live a "gray" or "black" lifestyle... outside of the societal norms... suffer the ostracism of peaceful people and suffer(by their choice) a bleak and horrible lifestyle.....Yeah...Im a dreamer.:soapbox:

It's not always illegal for women to be topless, even in public. I guess that makes it own more thing that varies fro locality to locality.
Quote:In 1998 a Maine woman who had been mowing her lawn without a shirt for three summers faced the threat of police action when a neighbor complained. However, Maine state law does not criminalize female breasts. When the neighbor put a law on the ballot to criminalize topfree women, town voters rejected it. Moreover, the citizens bought thousands of "Topfree Lawnmower's Assocation" t-shirts to show their support.
See http://www.gotopless.org/news.php?item.3.1 for nine more cases. Please note that, not surprisingly, there are pictures of topless women on the link (and not really the good kind either).

I recommend resolving the paradox using an arbitrary calendar date. It's all kind of simple when you think it through enough...

RE: Lucky to live in Alaska
Most states have now adopted an age range for when its legal to do the nasty with women under age. Virginia for example its never okay if the girl is under 14. If she's over 14 and the boy is within two years its okay. If he's within 4 years its a misdemeanor contributing to the delinquency of a minor, and if its more than 4 years its a felony. That keeps high schoolers from tapping middle schoolers. The term "San Quentin quail" has been around for a long time. And by the way, guys who do the nasty with young girls have a name in prison, it starts with B and rhymes with Witch.

OK...I just hope that none of our kids get busted for sex 1 day before that arbitrary date.

Are you proposing some sort of test before a person can drink, have sex, etc??? Pass the test and you can screw your brains out?
Personally, I find it quite ironic that a young man can be in the military and not be able to drink.

I think you have a great point on cultural norms and delaying the adulthood of children. "Coincidentally" that same education doesn't even enable students to identify that things have changed, let alone question whether the change is good.
But, I'm not sure about any age of consent being "arbitrary", and I'm not sure about prohibition being "evil".

By arbitrary..I mean whatever date you affix as a ceiling for criminality of an act seems harsh...if you arrest someone today...for an act that tomorrow...would be legal.
I call prohibition evil because it drives prohibited goods and services into the black market and fosters most of our countries crime...In the case of drugs...only two groups profit from the drug trade...cops and dealers.
You're right....Our education system does not foster critical thinking skills. Its just a government indoctrination system.

I'll agree with you that our (public) school system does not foster critical thinking skills because we've dumbed it down to accomodate people who are unable to speak English or that schools do whatever they have to in order to achieve certain performance numbers. My 10 year old son has ADHD with the rign of fire - this causes him to be impulsive and he loses focus. The school wants to ship him to another school that handles problem kids even though he's in the GATE program, a program for students who are capable of learning at a faster and more aggressive pace than others in his class. They want to do this because he requires more attention than the other kids. Yet they do nothing, because it's not PC, to do anything to kids who slow down the class because of their inability to be proficient in English.
I'll politely disagree with you that schools are a government indoctrination system because the ACLU makes sure that doesn't happen - including not reciting the Pledge of allegiance if a kid so chooses. I'll even go as far as to say that some of our higher education institutions almost frown on patriotism....remember, I said "almost."

I had a similar experience with my daughter...She has been a type 1 diabetic since age 2...My wife and I battled the PS system all the way through is insure that she was not treated differently because of what they described as "a disability". Well...She graduated 2nd in her class and is in college. Man...dont let these damn bureaucrats get away with anything...If you dont raise HELL constantly, they will screw you kid over and he will be just pushed to the side...I know..I went through this crap....I hope you son finishes #1 in his class.
My problem with the PS system and what I call "indoctrination" mostly revolves around with History education and its lack of fact and revision. I remember I was taught to revere Lincoln as "the man that freed the slaves"....As we now know...total BS. My daughter was taught the same sorry lie. Very little in current history teaching deals with the "failures" and "mistakes" that we have made as a country....Its mostly just flag waving, apple pie and "aint we great?"
You bring up the Pledge....This is a perfect example of "history not talked about"....The pledge was written by...Francis Bellamy...A German Nationalist Socialist(later called Nazis)....It was big in the fatherland after WW1 and spread to the US and was adopted in our schools. There are photos showing American schoolkids giving our flag the "Roman Salute". After the rise of Hitler...we quietly got our kids to stop the roman salute and put their hands over their hearts.
Funny...I never was taught the history of the pledge in school.

I'm glad your daughter was successful in spite of the efforts of the school system. You must be proud.
My son (step son, actually) has been labeled by the school's principal as a problem child instead of a child with a problem. My boy often loses his focus in class when a child with turrets syndrome acts up. The school tolerates this acting up, as they damn well should, but they chastise and suspend my son when he acts up. Twice we had to drag a lawyer to the school and threaten to sue them because they refused to recognize ADHD as a disability even though their own psychologists agreed with everything we gave them from our private doctors. The principal selectively enforces the Americans With Disabilities Act and suspends my kid at will over actions caused by his legally recognized disability. It was one of those suspensions that caused me to barge into her office and, not once, not twice, but 3 times telling her to F**k herself all while flipping her the bird. I also told her the very thing civil servants never want to hear: My taxes pay your salary and that means you work for me." She went ballistic and called the cops - who laughed it off. My wife made a deal with her in that if I stay away from the school my she'll do more to work with my son's disability. Extortion, you gotta love it. I hate that witch.

We also used the ADA against the school a couple of times. Because of occasional low blood sugar episodes, my daughter always caries with her "kit" with contains glucose tablets and snack. We had to down to the school each year and explain to every teacher that she "would" be allowed to "eat" in class if her blood sugar level got low. I had one teacher tell me that "she did not allow that in her class "for any reason". Needless to say...I lost my cool kind of like you did. Its amazing just how idiotic some people can be.
