The chief of the UAB police department was placed on paid leave Monday, according to a university spokeswoman.
UAB spokeswoman Dale Turnbough said the decision came after Chief Harry Marzette was stopped by Mountain Brook police on suspicion of drunken driving.
Mountain Brook Mayor Terry Oden said police received a call of a car being driven erratically along U.S. 280 Fridaynight. Officers stopped the car, a Crown Victoria with a state-issued license plate, being driven by Marzette.
Oden said the officer reported that Marzette appeared to be impaired but drove him home instead of arresting him.
"It's the officers' discretion whether or not to arrest someone," Oden said.
The mayor said he will see if the officer's actions were in line with department policy.
"If it wasn't, we'll take care of it," Oden said.
UAB Police Capt. Jimmy Nordan, second in command at the department, will assume administrative responsibilities while university officials investigate.
Turnbough said university officials heard of the incident Monday and asked Marzette to step down as chief after discussing it with Mountain Brook officials.
Marzette joined the University of Alabama at Birmingham police in 1985 after a 20-year stint as a patrol officer and robbery and organized crime investigator with the New York City Police Department.
Marzette was UAB's deputy chief in October 1994 when he was named acting chief following the resignation of Chief Patrick J. Murphy.
Several days later he was named chief.
Efforts to reach Marzette Monday night were unsuccessful.
If I recall, Murphy resigned because of a huge scandal himself. We don't have such a good track record with police chiefs.

Marzette is crooked and needs to be canned for more than just this.

Kirksville, I believe Murphy's scandal was a lot more than something like this. Weren't you at the Kaleidoscope back then - or was that Chief Kilpatrick/Kirpatrick?
