I've never understood why smokers believe that exercising their "right" to smoke overrides my "right" to not breathe said smoke. Their choice, by its very nature, impedes on my ability to choose.
Now, I'm all for people doing whatever they'd like to their bodies - to the point that I think marijuana should be legalized and taxed similarly as cigarettes. But I don't believe that making that choice to partake allows you to impede on my choice to not partake.

....and like people get my Schiavo stance confused, people get this stance confused as well.
It's not about a smoker's "right" to smoke. never once have I said, "Hey, I have a RIGHT to smoke in that establishment". That would be akin to saying, "Hey, I have a RIGHT to eat in that establishment without smelling smoke". NEITHER is a right. This is about the business owner's right to cater to whom he/she chooses. If they want it non-smoking, so be it.
The ONLY constitutional directive the government can mandate, IMO, is making them place placards on the front doors.
