Doesn't it also have to do with Title IX?
Lots of schools are cutting men's sports to equalize the number of scholarships between men and women athletes.
The only way schollies go back up to 100 is if schools cut other men's sports..and that would be bull.
85 is plenty of scholarships... if you decide to walk-on at a school, that is your prerogative (especially if you're someone who turned down scholarships from smaller schools to attend a larger one). Don't whine about it when you don't get a scholarship.

Turn down a scholarship from another school, sue the one you went to with no promises.
It would seem to me that scholarships are readily available at D-II, 1-AA and NAIA schools across the country.
They CHOSE to walk-on. They weren't forced.

Maybe someone will sue saying NFL roster limits are anti-competitive.
Maybe someone will sue to get into a particular division of the armed services, saying Sect. Rumsfield has set troop strength too low and depriving him or her of an opportunity to go to Iraq...
I assume the NCAA is free to set limits for any sport as part of their governance.

Agreed, Swim-guy. You really can't ***** about your financial position when you choose the worst financial position offered because you thought you might be able to really impress.
With 85 scholarships, you have to figure that a school would like to at least be two deep with mostly upperclassmen, then have the next set be in development, ready to step in as upperclassmen when they get there. They're never going to offer a scholarship to a 4th year junior 6th WR (for example) - you have to truly impress.
FWIW - NIU has gotten some excellent mileage out of walkons since Novak has been coach. All-MAC selections LB Brian Atkinson, DE Travis Moore, & CB Randee Drew were all walkons.

I agree with you guys, but I wouldn't doubt if he wasn't promised something to sweeten his position to walk-on there rather than head to a certain scholarship. He made the choice, but if he was represented that the next year he would get a scholly or something along those lines to get him there, then that would be actionable, IMO. Proving it is another problem altogether.

Of course a coach will say that a kid has a chance to earn a scholarship. Its true..he has a chance..its just very small.
This lawsuit won't get far. It's like a kid suing Jack Daniels for making him drink underage.

And that is the key. A coach will tell a kid that he has a chance to earn a scholarship, but that's not a promise of a scholarship.
Now, if a coach promised a grant and didn't deliver, they should find a way to deliver. That is an instant credibility loss.
