The Protect College Sports Act of 2026
I have spent some time reading parts of the Protect College Sports Act of 2026 recently and discovered the following Section that surprised me:

SEC. 128. PROTECTING OPPORTUNITIES FOR AMERICAN
STUDENT ATHLETES.

It is the policy of the United States that any institution of higher education participating in intercollegiate athletics should prioritize domestic students in the selection of student athletes and the awarding of athletic opportunities, including grant-in-aid and roster positions, on the varsity sports teams of that institution.

This paragraph essentially would end the practice of looking for college athletic talent outside of the United States, which seems pretty short-sighted to me. Sports is the ultimate meritocracy and this provision is protectionist and poorly thought through and counter productive.

Imagine no Christian Covington or Luke Wilson competing for the Owls Football team, no Kazemi, Oraby, Suleimon Braimoh, Paulius Packevicius, Dylan Ennis, Jarne Elouna Eyenga, Zalan Flasar, Egor Koulechov or Alex Bougaieff playing Rice men's Hoops.

Hopefully this provision gets nuked as the bill continues to get amended while in the House of representatives or in conference committee assuming the bill moves forward.

Even the biggest diehard MAGA types probably aren’t against immigration if it helps their sports teams. Typical hypocrits (not you - I’m just railing on MAGA)

The words “should prioritize” render this proposed policy toothless.

Should means golly thanks it would align with our policy of you even decide to implement this on your sports teams

Prioritize can mean lots of things, including something as minor as using domestic status as a tiebreaker when all else is equal, or contributing one point toward selection criteria (with traditional factors accounting for the other 99 points).

But on the surface it sounds like it also would endorse a discriminatory quota system.

And potentially ruin one of the really good things about team sports, the concept that everyone has a fair shot.

Taking a few steps back and over...

No Hakeem Olajuwon, Garo Yepremian.

This is not a short list:

The wording would allow for a cause of action to be taken by those who feel they were not given the opportunity for the position due to their national origin. It is not appropriate to try to legislate this type of exclusionary language in the proposed legislation.
