Dems turn to Supreme Court to curb Trump's tariff power
A Federal Appeals Court ruled 7-4 against Trump. A loss at SCOTUS could cost hundreds of billions in revenue. Dems are pushing to have Congress solely in charge of tariffs.

That would be a cluster fk.

Quote:Dems turn to Supreme Court to curb Trump's tariff power
In August, the U.S. Court of Appeals for the Federal Circuit affirmed a previous lower court ruling, but said Trump's tariffs could remain in place while the administration appeals to the U.S. Supreme Court.

Democrats want the U.S. Supreme Court to do what they haven't been able to in Congress: Take away President Donald Trump's tariff authority.

Since retaking the White House in January, Trump has used a 1977 law that doesn't mention tariffs to reorder global trade. Trump has imposed import duties on every major U.S. trading partner, citing authority under the International Emergency Economic Powers Act of 1977.

A group of small businesses, two Illinois toymakers and a group of Democrat-led states have challenged Trump's authority under the law. The Supreme Court has agreed to hear the case with oral arguments set for Nov. 5.

Trump said the case is so essential to the country's economy that he might attend personally.

Some 207 members of Congress, almost all Democrats, told the Supreme Court in a friend-of-the-court brief that the president overstepped his authority.

"When the President wishes to impose tariffs, he must comply with the existing, lawful delegations of tariff power that Congress has enacted or, if he finds those authorities insufficient, ask Congress for new authority," the group wrote. "Here, however, the President has usurped Congress's constitutional authority by impermissibly using the International Emergency Economic Powers Act."

The Democrats said Congress never delegated such power to the president.

Excellent. If the SC does its job we’ll have lower inflation, a tax cut of a few hundred $B, and a reminder to dear leader we have a separation of powers that is crucial to our republic.

Win-win-win. Too bad I have to faith in the SC to hold to the constitution

That may be the sticking point that compels the supremes to rule in Trump's favor. A reasonable response would be that he followed the law and the same practices as other presidents before him and that if the Dems don't like the law, they should work to repeal or replace it.

The Democratic base is too naive to realize that their leaders are actively working to radically alter America and reshape it into a communist nation that suits them. The base fails to recognize that everything their leaders say and do is merely an attempt to convince voters that they are diligently working to protect them from the GOP by enacting new laws and regulations, which will ultimately be detrimental to them as well. The nation as a whole will suffer from their efforts, but the majority of them are too dim-witted and enmeshed in their conditioning to see beyond their noses.

We have at least 3 of them here. They appear to be masochists who enjoy the pain and humiliation they have suffered at our hands. Or they are just that stupid.

precedent carries major weight ... it's basically the same case as ruling on Roe v. Wade ... this court knew it was best to place it in the hands where it belonged to begin with ... they fully realize congress can always create a new law/amendment if/when they disagree vs. ruling by E(l)mo...

they also know if passing tariffs was limited to congress, it would chinstrap the ability to maneuver as req'd in this fast-paced ever-chaning economy ... when was the last time congress moved anything thru of value; much less at a reasonable pace ... they know that, too...

There is another argument, as well. Until the federal income tax was established, we used tariffs to fund the government. That was managed by the Executive Branch, not by Congress.

Quote:The Secretary of the Treasury managed the U.S. tariff program before the federal income tax, with early Secretaries like Alexander Hamilton playing a key role in establishing and advocating for tariffs as a primary source of revenue. The Secretary of the Treasury was responsible for the administration and collection of tariffs, which were the main source of federal government income for much of the nation's early history.
