SCOTUS Sides with Trump, Grants Request to Lift Order Blocking Deportation of 8 Illeg
Quote:The US Supreme Court 7-2 on Thursday granted the Trump Administration’s request to lift a Biden judge’s order blocking the deportation of the 8 illegals currently stuck in Djibouti.

Liberal Justice Sonia Sotomayor fumed in her dissenting opinion. Justice Jackson joined Sotomayor.

“For all that, moreover, the majority does not actually clarify its prior decision. The majority says it expects “that the District Court will now conform its order to our previous stay,” ante, at 2, but it refuses to explain what such conformity would involve. As a result, today’s order not only excuses (once again) the Government’s undisguised con-tempt for the Judiciary; it also leaves the District Court without any guidance about how this litigation should proceed. The District Court cannot adjudicate plaintiffs’ serious due process claims on their merits without ensuring, byway of injunctive relief, its jurisdiction over the case. Yet this Court refuses to explain what injunctive relief, if any, it believes the District Court can issue,” Sotomayor wrote in her dissent.

“Perhaps the majority hopes that, in light of its content-less stay order, the District Court will simply give up on adjudicating this case. But if this Court wishes to permit the Government to flout the fundamental rights guaran-teed by the Due Process Clause, it cannot avoid accountability for that lawlessness by tasking the lower courts with inventing a rationale. The Court’s continued refusal to justify its extraordinary decisions in this case, even as it faults lower courts for failing properly to divine their import, is indefensible,” Sotomayor said.

Sotomayor said the Trump Administration has the Supreme Court on speed dial.

“In a democracy, power implies responsibility. The greater the power that defies law the less tolerant can this Court be of defiance. As the Nation’s ultimate judicial tribunal, this Court, beyond any other organ of society, is the trustee of law and charged with the duty of securing obedience to it.” Mine Workers, 330 U. S., at 312 (Frankfurter,J., concurring in judgment). This Court continues to invert those principles. Today’s order clarifies only one thing: Other litigants must follow the rules, but the administration has the Supreme Court on speed dial. Respectfully, I dissent,” Sotomayor said.

In May, US District Judge Brian Murphy, a Biden appointee, said the Trump Administration violated his court order to provide the aliens with “meaningful” due process since they were being sent to “third-party” countries.

Some of the aliens are from Laos, Vietnam, and Cuba, so sending them to South Sudan puts them in danger, attorneys argued.

President Trump fumed and said that because of the judge’s order, 8 of the most violent criminals on earth are currently being held in Djibouti, a tiny country on the Horn of Africa next to Ethiopia.

The US government doesn’t even have a detention facility in Djibouti, so 11 ICE agents are detaining the aliens in a conference room in a converted Conex shipping container on the US Naval base in Camp Lemonnier, Djibouti.

The judge’s order put ICE agents in danger.

A previous court filing revealed the hellish conditions for the ICE agents forced to live in thanks to the Biden judge.

ICE agents who are living in 100-degree heat are at risk of Malaria and rocket attacks. There are also limited sleeping quarters, limited lighting, and significant security risks.

“The aliens are currently being held in a conference room in a converted Conex shipping container on the U.S. Naval base in Camp Lemonnier, Djibouti. This has been identified as the only viable place to house the aliens,” ICE said in a court filing.

The agents are also at risk of rocket attacks from terrorists, yet they lack the proper body armor.

“Upon arrival in Djibouti, officers were warned by U.S. Department of Defense officials of imminent danger of rocket attacks from terrorist groups in Yemen. The ICE officers lack body armor or other gear that would be appropriate in the case of an attack,” ICE said.

DEVELOPING: Hours After Supreme Court Ruling, Obama Judge Temporarily Blocks Trump Admin From Transferring 8 Illegals in Djibouti to South Sudan

Quote:Happy Independence Day!

Just hours after the Supreme Court issued a ruling, a federal judge temporarily blocked the Trump Administration from transferring the 8 illegal aliens stuck in Djibouti to South Sudan.

Judge Randolph Moss, an Obama appointee, held an emergency hearing before a flight scheduled for 7 pm departed Djibouti to transfer the illegals to South Sudan.

Judge Moss punted the case to a district court in Massachusetts and gave the plaintiffs’ attorneys one hour to file their emergency claim.

Judge Moss in DC (Obama) formally transferred the case the case to Judge Murphy (Biden) in Massachusetts.

The Trump DOJ said they would immediately appeal to the Supreme Court.

The US Supreme Court 7-2 on Thursday granted the Trump Administration’s request to lift a Biden judge’s order blocking the deportation of the 8 illegals currently stuck in Djibouti.

Liberal Justice Elena Kagan joined the conservative justices and issued a concurring opinion.

However, liberal Justice Sonia Sotomayor fumed in her dissenting opinion.

Per the OP, due process is no longer enough for criminal illegal aliens? Now it has to be “meaningful” due process? Who decides what that standard is?

BREAKING UPDATE: Biden Judge Denies Emergency Motion So the 8 Illegals Deported by Trump will be Flown From Djibouti to South Sudan TONIGHT

Quote:Update: Judge Brian Murphy, a Biden appointee, denied the emergency motion filed by the plaintiffs’ attorneys so the 8 illegal aliens stuck in Djibouti will be flown to South Sudan tonight at 7 pm ET.

As reported earlier, just hours after the Supreme Court issued a ruling, a federal judge temporarily blocked the Trump Administration from transferring the 8 illegal aliens stuck in Djibouti to South Sudan.

Judge Randolph Moss, an Obama appointee, held an emergency hearing earlier Friday before a flight scheduled for 7 pm departed Djibouti to transfer the illegals to South Sudan.

Some of the aliens are from Laos, Vietnam, and Cuba, so sending them to South Sudan puts them in danger, attorneys argued.

These criminal alien killers and rapists are so dangerous that their own home countries refused to take them back so the Trump Administration deported them to South Sudan.

Judge Moss punted the case to a district court in Massachusetts with Biden-appointed Judge Brian Murphy (the original judge assigned to the case) and gave the plaintiffs’ attorneys one hour to file their emergency claim.

Later Friday with just an hour to go until the plane in Djibouti was set to depart, Judge Brian Murphy denied the plaintiffs’ emergency motion to stop the transfer to South Sudan.

Judge Murphy said the Supreme Court already granted the Trump Administration relief on this matter.

“This Court interprets these Supreme Court orders as binding on this new petition, as Petitioners are now raising substantially similar claims, and therefore Petitioners motion is denied,” the judge wrote.

The US Supreme Court 7-2 on Thursday granted the Trump Administration’s request to lift judge Murphy’s order blocking the deportation of the 8 illegals currently stuck in Djibouti.

Liberal Justice Elena Kagan joined the conservative justices and issued a concurring opinion.

However, liberal Justice Sonia Sotomayor fumed in her dissenting opinion. Justice Jackson joined Sotomayor.

Sotomayor said the Trump Administration has the Supreme Court on speed dial.

Why, a federal judge, of course! LOL

For many years, the preferred buzzwords in cases like this were “substantive due process”. I guess maybe they've moved on to “meaningful due process”? Stay tuned!

Why do you need freaking due process when the current law says if you're here on a visa, you are required to carry your papers with you at all times?

So...if a law enforcement officer approaches you for a legit reason, and asks for your visa papers, and you can't produce them, THAT is due process, and out you go!

Quote:After weeks of delays by activist judges that put our law enforcement in danger, ICE deported these 8 barbaric criminal illegal aliens who are so heinous even their own countries will not accept them.

This was a win for the rule of law, safety and security of the American people. We thank our brave ICE law enforcement for their sacrifice to defend our freedoms.

We will continue to fight for the freedoms of Americans while these activists continue to try and force us to bring murderers, pedophiles, and rapists back to the U.S.
