Before recent times (aka BLATANTLY activist judges), everything basically came down to the honor system between the executive and judicial branches.
Now? Those old courtesies are a thing of distant memories.
I would suggest that it's in everyone's best long term interests for these things to advance up the judicial system (in a hyper-expedited fashion) all the way to the Supreme Court if need be so that clarity can be restored.
And before judges lose any remaining credibility and the executive branch simply begins to ignore them.
From what I heard recently, their enforcement mechanism is the US Marshals Service (USMS) who is under the Attorney General.
And your post is quite chilling if you workshop what this could lead to.
1. trump and elmo break the law.
2. Judges hear cases and make rulings.
3. trump and elmo ignores the ruling.
4. Judge asks USMS to enforce ruling.
5. AG tells USMS not to enforce ruling.
6. President elmo and dictator trump do whatever the **** they want.
Perhaps you see now why many people were worried another trump term might be the end of democracy.

except that one of the judges has already backtracked off of his ridiculous ruling.

The courts should've stayed out of it since Trump is doing exactly what the Constitution is allowing him to do. But since they want to play, why don't we send this all the way to the Supreme Court? As for Congress, they have no say in this whatsoever once they've allocated funds to the executive branch.
Tom: The Constitution is clear. The courts overstepped their bounds. But whatever. Stay mad.
I'm not mad. If anything, I'm in shock. Shock of how you clearly didn't pay attention in any civics class you might have taken.
The Constitution also gave the Judiciary the power to review and declare executive actions unconstitutional.
They, along with the Legislature, are co-equal branches of government.
And from SCOTUS precedent, the president is pretty much required to spend the money on the things congress tells him to spend it on. It's why we don't have a line-veto, which even Scalia said was unconstitutional.
But since trump is pressing this matter more than ever before, it's ENTIRELY appropriate for the courts to take these cases up...and yes, many of them will likely end up back at SCOTUS.

An executive action that undoes another executive action is not unconstitutional under any means.

Quote:Line-item veto is the power of an executive authority to nullify or cancel specific provisions of a bill, usually a budget appropriations bill, without vetoing the entire legislative package. Forty-four of the 50 U.S. states give their governors some form of line-item veto power

Tom, only in your wet dreams will Trump and Elon (not elmo) break the law, get ruled against, ignore the ruling, and then Bondi tells the USMS to stand down.
Trump said at a presser yesterday that he has full intention to abide by any court ruling, as he has always done. In case you forgot.
You really need to see a doc about your condition. It's getting worse.

Didn't Biden stop construction of the border wall that was fully funded and then sell the steel for pennies on the dollar? I don't remember the ugly Democrats cursing in the streets about that. Marxists hate audits. But by all means keep it up Ugly Democrats. Lots of campaign material being gathered. "How dare you save tax dollars on wasteful spending, Fascists!"

The Constitution itself does not explicitly grant the judiciary the power to review and declare executive actions unconstitutional.

Federal Judge Makes Ruling Against Trump Admin That Might As Well Be a 'Soft Coup'
Basically every court case thus far is a judicial of overreach of power.

the courts no longer protect the land of opportunity, but the workaround the workaround thingy...
it's sad watching all this play out in real time...
addendum: building is always the most exciting of potions; once saturated, it then becomes the elixir by taxing to maintain the burden...

Key Point...the Supreme Court is the only branch of government that the Constitution has deemed equal to the Executive and Legislature. The lesser federal courts were created by Congress to reduce the administrative burden...they are not equal to the other two

The judge who restrained Trump just issued a new statement clarifying his original ruling, saying that the President has the authority to direct funds within the Executive Branch, as long as he doesn't break any other laws.
LOL. IOW, the judge screwed the pooch.

He blocked the land grab that Trump wanted. The reason why is that farmers and ranchers own land that are on both sides of the border. One household of a farmer who is a US citizen would have put their home on the southside of the border.
