If she was prone to do that, or going to do that, the jury instructions are public domain filings on the internet already.

The 'bad thing' that could happen in each of the outcomes noted above can be done with or without the physical instructions in her hand.

There is absolutely no reason to take them home unless she wants to do something improper with them. She is supposed to be reading them in the jury room and discussing only with the other jurors. Maybe she doesn't know the instructions have been posted online. She's not supposed to be reading about the trial.

As to the second italicized you are spot on correct. I dont believe as much as to the bolded.

As to the first italicized, your statement of '*no* reason except improper ones' isnt correct.

There is zero issue with a juror reading the instructions at home, trying to discern exactly what they mean or the intent is. Think of it in this way --- there is no issue as to a juror reading them in the jury room. But somehow reading them away from the jury room is 'improper'? Sorry, but there *are* proper things a juror can do at home with them.

The issue at stake is whether the chances of 'something improper' are increased. they are. Absolutely. But, to no more of a level of a juror using an online version of the instructions in absolutely the same way. So the odds of increasing arent really 'increasing', they are the same for the most part.

And you need to finish the last part of 'she isnt supposed to be reading about the trial' --- the reading should be understood to mean 'accounts of the trial' --- instructions arent accounts of the trial. And the implied restriction should be 'accounts of others' about the trial. She can certainly read her own notes made during the trial one should imagine.

In the jury room or has it changed that any work done/notes is to be left once they are finished fir the day and the bailiff takes them and gives it back to the jury the next day?
