That's going to be the issue.. with or without prejudice.

I think he's trying to let the Jury have the final say, and if they either can't come to an agreement or they come back with "guilty", he's going to mistrial it.

Not going to happen, dont think he has the guts to take what the media will give him. Its very clear this judge cares (maybe too much) what is being said about him.

I think he's hoping for a acquittal so he doesnt have to make a ruling. If its guilty he will let the appeals court take it up. At least three times this judge has talked about how the media and his peers is judging him. Hell once in the middle of the defense talking about the video...he went off on it.

The defense shouldnt let him get away with this and stand up in court and demand it. Instead they are being wishy washy. Hell they even gave the judge a out by now asking for a mistrial without prejudice.

His client would have had to agree to allow him to do that. He said without prejudice because this case is now so effed up with the evidence presented they will not likely want another bite at the Apple.
