(1) A person is privileged to threaten or intentionally use force against another for the purpose of preventing or terminating what the person reasonably believes to be an unlawful interference with his or her person by such other person. The actor may intentionally use only such force or threat thereof as the actor reasonably believes is necessary to prevent or terminate the interference. The actor may not intentionally use force which is intended or likely to cause death or great bodily harm unless the actor reasonably believes that such force is necessary to prevent imminent death or great bodily harm to himself or herself.

As in TN, a person has the right to use deadly force is he reasonably believes he is at risk of BODILY INJURY or death.

I don't have to think you're going to kill me. All I have to think is that you're going to inflict injury on me.

A skateboard to the head can inflict serious injury.

A gun pointed at your head can inflict serious injury.

A crazed maniac who threatened to kill you and is chasing you and lunging at you can inflict serious injury.

And in every one of those instances, the other person acted first. Shot were fired ONLY after the other person engaged in threatening behavior.


In Rosenbaum's case, he not only made threats of death but he acted on them by chasing the person to whom he threatened to kill.
