Liberty proved that anyone can sue their way into the FBS. You just need to have the wherewithal to front the time and legal costs that such a battle will require.

So if it comes to that, we can rule out any of the WAC FBS wanna bes. They definitely don't have the money. Maybe in 5 years. Liberty is a whole other class of institution.

Liberty would have used a religious slant to any potential lawsuit either. What discrimination can the WAC claim?

Whatever their lawyers want to conjure up. With the new 12 team playoff structure pending, I'd really question any significant opposition to schools wanting to go FBS indy. And if the cartel was really that worried about any new move ups, they could just raid a couple of the best WAC FB candidates and knee cap any potential "in mass" move up attempt.
