The CFP is a private organization separate from the NCAA. It’s run by an 11-member commitee representing the current 10 FBS conferences and Notre Dame who decide among themselves how to divvy up the cash they earn from their contract with ESPN. Unless ESPN is pushing them to do it, there’s no incentive for the current committee members to add a 12th member or change the cash distribution formula to include the WAC. I disagree - if the 10 current FBS conferences were to exclude the WAC and the ASUN from CFP payouts, that would obviously be anticompetitive behavior.

If the CFP could get an antitrust exemption like the big four leagues have, then it's a different story.

I wonder if that would require them to file as official sports league. Maybe semi pro?

It would require an act of Congress.

And as a side note, I don’t think the WAC would necessarily have to sue. If the WAC was excluded, I think that a peeved New Mexico or Texas Attorney General could go after the CFP. At least in my home state, the AG frequently goes after trusts. Whether or not that is a good use of an AGs time is another question.
