IIRC the joint statement about discussions preceded the new information

I thought this was the first we were hearing about the joint statement, but it's referenced in the Idaho Statesman Jan 22 if I have the right link.

The joint statement is old, in the context of Boise's lawsuit. But that means the language is overtaken by events.

Agreed. The discussions were underway by Jan 22, they have now reached an agreement on a truce--MWC rescinds the vote, Boise drops the lawsuit.

Pretty much agreed. Boise State would like a bigger bonus, but the legal situation is now reversed. Before, the MWC wanted various things, and Boise State pointed to the black-letter text of the contract and said "This, and not a penny less." Now the MWC is pointing to the text and saying "This, and not a penny more."
