My understanding is that the Justices communicate with each other during the deliberation process, and have a clear idea of how the vote is going to go. If he was trying to prevent Ginni's emails going public, he must have known this was futile.
So,, if the intent was to cover up supposed undue influence on him from his wife, he would have better achieved that by voting with the other 8.
