The NCAA probably would have won a lawsuit, citing the precedent set in Dale v Boy Scouts, which clearly allows for private organizations to set their own membership criteria. If the NCAA wanted to play hardball, they'd simply pass a rule stating that NCAA member organizations cannot discriminate in hiring or participation on the basis of religion, sexual orientation, or marital status.

Dude, thanks for proving my point. Never said they were on par but they have as much right to be FBS as any other school. Personally I am all for getting politics out of sports. I think you will be seeing a right turn with the Supreme Court coming hard and fast. About as much as it took a left turn the past 8 years. Sadly, there is no middle road even in the judicial system going forward. Only hard turns. NCAA better learn from the NFL, political stands don't help ratings.
