This happens here sometimes, and I mean Michigan. Unconscious patients are taken to court—in secret—and their caregiver/patient advocates show up to the hospital the next day and discover the hospital has placed a guardian over their loved one and it's lights out. This is an abuse of our legal emergency procedures for care decisions.
Nothing this egregious happens in the daylight, but the problem is there is not a lot of daylight here. And it's getting worse and worse. Hospitals can slip secret DNR or other medical orders into your file, even if you express a wish for CPR or other active care measures.
Hopefully both those things will be changed soon, there's bills in the Legislature. Another change would be making the presumption that it is in the patient's best interest to be alive, and those who want to take away care have to rebut that, rather than the burden of proof resting on the sick and disabled.
