This is a serious problem and until something is done about it, it will only get exponentially worse. One citizens legitimate vote cancelled by an illegal or simply manufactured vote is one to many. Regardless of who the citizen voted for.

No, a few hundred votes out of 8 million is NOT a serious problem. And it's not getting exponentially worse. You do know what exponentially means, right?

13 states do not require *any* documentation to vote. Thats 26% of the elections. Another 9 only need non-photo documentation. That brings the loose or no ID to 44% of the nation. I think your #1 isnt on point.

For 2 -- states can absolutely run their own *state* elections with whatever criteria they deem they want.

The Elections Clause allows states to run votes for Senate and Congress. But for that issue, Congress can absolutely override the states for Congressional elections. The only issue is that Congress cant make a regulation changing the "Places of choosing Senators" prescribed by the states.

Presidential is left to the legislatures of the states.

That would be a bad guess. But ignorance of the law is no excuse.

If you don't prosecute them then you never find out what really happened.

138 voted knowingly illegally.
138 voted without knowing it was illegal.
138 didn't actually vote themselves.

Or some combination. They need to be prosecuted even if all sentencing is suspended.
