Internet posting damaging man's life - DrTorch - 07-29-2014 12:49 PM

Quote:What if you woke up one day and found that someone had posted a litany of unfounded accusations about you on a website?

What if you tried to ignore the website but then discovered it was popping up at the top of search results on your name, keeping you from getting job offers, making people at work snicker about you behind your back, even interfering with some of your friendships?

This is the nightmare facing Surya Panditi, Cisco's senior vice president and general manager of Service Provider Networking Group, a unit responsible for some of the company's most advanced networking products.

For two years, he has been unsuccessfully trying to get rid of a website hosted on Wordpress.com that accuses of him of incompetence and corruption at work and having an affair.

Burgoyne says that Panditi doesn't have a choice but to try and expose the identify of Corporate Renegade.

That's because the law currently leans in favor of freedom of speech, making it very difficult for people to get critical websites taken down, Burgoyne says. In order for a blog, comment or site to be declared by a judge as defamation, the courts prefer that a defendant be present in court.

"In a situation like this, where you don’t know who [wrote the website] who the defendant is, you can’t move the case forward until you’ve exhausted every effort to find them.

Seems like the courts need to adapt to the changing times.

Seems the burden should be on the blogger proven what he writes is true rather than the victim proven the blogger is a d(ckhead.

Yeah, and if he won't come forward then the host sites should take him down. That seems the simplest and frankly most reasonable approach.

Shouldn't be a burden to this guy to spend months trying to track down a guy. If you post you either prepare to back up your words, or get them taken down.

I used to work for a reputation management company. With some SEO work he could start to bury that in the search results. However, thanks to sources like Business Insider, the more people who click on the story, the more Google views it as a relevant result.

He does have a libel case and should pursue it.

Libel is not covered under the 1st amendment.

Against who? That's the problem.

If there is a substantial libel charge, Wordpress will have to give up that author.

This has happened before.

Yeah I was going to post something similar.

It really isn't terribly difficult to get things pushed down, but your average person doesn't know that and they probably wouldn't want to spend thousands on a reputation management company to do it.

Alternatively, you could blast it thousands of spammy links and simply have Google remove it from search results. I guess that could backfire though if they don't because then it would be impossible to push down.

I don't really have to worry about reputation online because a big time body builder has the same name as me, so he is all over the place if you search for my name.

That is the problem and it's getting bigger. Here's an extreme example in the other direction:

Don't know if anyone watches motorsport, but Max Mosley is suing Google due to pictures (Photos of him dressed as a Nazi while being spanked by prostitutes portraying the role of concentration camp victims) showing up in search results.

If you read the article you see that he already went that route.

He hired a bad one then. It's not really that difficult.

My daughter-in-law is experiencing something similar right now. It's believed that a former co-worker whose advances she rebuffed has started spreading her name around the dark web implicating her in all manners of illegal behaviors, proving it is who is suspected is proving to be a problem.

This sort of thing depends, primarily, on wether or a not a person is a public or private figure. I would have thought this person would be a private figure more like Joe Blow than a public figure, or a person who has thrust themselves into the public view.

I'm not a law suit kinda guy but I do like to take matters into my own hands. If someone f**ked up my life, if I could find him, I'd take a baseball bat to his arms and legs. Yeah, compare me to a cave man or a Muslim, see if I care.
