It depends on what the laws of the state say about that. The effect of this legislation is to remove state and local gov't resources from aiding the federal gov't in policing certain federal statutes. And second, to nullify federal rules that are enacted to reduce gun ownership by law abiding citizens. The legality of the second is going to be complicated though. Well, I hope that you teach your students that Missouri isn't in the south. Just because they play in the SEC doesn't make them southern. If that's the case, then you shouldn't be using this as a "teaching moment" for anyone. But, I'll help you. The major chunk of this statute merely says that Missouri is no longer going to help enforce federal law regarding gun control. No different than sanctuary cities. Sanctuary cities aren't something that comes up in the first part of U.S. history. Nullification does. So whenever a state uses nullification in current events, it because a teaching moment for my students to refer to. No, the state declares what is and isn't an illegal weapon in Missouri, and what kind of carry is allowed (right now Missouri is concealed carry, and you're permitted to have guns in your vehicles, as long as they are separated from the magazine and unloaded.) But there are still some limits as to what you can / cannot carry. I don't have the full list though. Federal officials cannot come in and usurp the authority of Missouri to arrest/prosecute if Missouri says nothing illegal is going on. This isn't actually nullification; I'd hope teachers would pay more attention to particulars. |
