However, Swarbrick revealed Monday that Notre Dame is not subject to early-exit penalties like the ones recently negotiated for Pittsburgh, Syracuse and West Virginia.

Big East rules allow schools to leave as a group without being obligated to pay exit fees, which is exactly what Georgetown, Villanova, Marquette, Seton Hall, St. John’s, DePaul and Providence are doing.

“We withdrew under the same agreement that the seven basketball schools withdrew under,” Swarbrick said. “We don’t owe any withdrawal fee — never have. It’s not in dispute; never has been. The nature of that separate agreement provides that we don’t. It’s a different dynamic with us. We’re not trying to negotiate a withdrawal fee; there isn’t one.”

Where ND would owe a fee would be if they are leaving prior to the 27 month period elapsing.

They are withdrawing as a group. Nothing states that they have to land in the same place. Though I think steve is right that if ND leaves before the 27 months they indeed do have an exit fee. All of that will be negotiated out with the C7 stuff. Doubt ND pays anything as it will come out of any money that would have been theirs and negotiated as settlement.

If ND leaves short of the 27 month notice, it may owe $5million or less.

It gets complicated. Here are some quotes:

Apparently, the only issue is the 27 month waiting period:


"The question all along has been whether or not Swarbrick would comply with Big East bylaws, which requires 27 months notice in order to leave the Big East without penalty, or go ahead and join the ACC next fall. This article says that they will have to negotiate an exit fee if they leave sooner:

This one says that Notre Dame's exit fee is $5 million dollars:

"Big East bylaws require a departing school to pay a $5 million exit fee and provide a 27-month withdrawal notice before leaving the conference. Notre Dame AD Jack Swarbrick said during a press conference Wednesday night that the school intends to meet its contractual obligations with the Big East. Swarbrick declined to comment specifically on if the school plans to leave the conference before the start of the 2014 season."

It is a bit confusing.

Whatever the situation, I don't think that an exit fee is all that big of a deal for ND.

Notre dame doesn't have room for that with their acc agreement.

ND already told the Aresco League "no" to that.


"The Big East previously offered Notre Dame the chance for an earlier exit if the Fighting Irish would schedule future football games against Big East opponents, a source said.

But Notre Dame, with five annual games against ACC opponents starting in 2014, told the Big East it didn't have any future openings and was unable to accommodate the request."

Notre Dame was part of the basketball schools, so if they leave Notre Dame needs to leave with them, otherwise they can't leave. Swarbrick has them over a barrel, he can slap an injunction on the C7 saying they can't leave on their own. That would cause the Fox money to go Bye Bye!

Sounds like the ND exit fee could be what ever they paid for the postage to send their notice to Providence. Wouldn't surprise me if the BE reimbursed them for the postage though.
