Appeals Court: Prop 8 unconstitutional - wvucrazed - 02-07-2012 01:21 PM

This is great news, and the right decision. Now on to the SCOTUS.

http://www.washingtonpost.com/politics/calif-same-sex-marriage-ban-ruled-unconstitutional/2012/02/07/gIQAMNwkwQ_story.html

A federal appeals panel in San Francisco ruled Tuesday that California’s ban on same-sex marriage violates the constitutional right to equal protection.

The panel overturned Proposition 8, which was approved by 52 percent of the state’s voters in 2008 and amended the state’s constitution to limit marriage to a man and a woman.

The court’s decision upheld a 2010 decision by former Judge R. Vaughn Walker that found marriage to be a fundamental right protected by the Constitution, and that the proposition “fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license.”

Great news? Right decision? Wow, you really are illiterate.

The courts go beyond their intended purpose and destroy the will of the citizens. History hasn't shown tyranny to be pleasant.

RE: Appeals Court: Prop 8 unconstitutional - UofMemphis - 02-07-2012 01:26 PM

it IS unconstitutional...it does nothing but deny rights to a single group...more importantly, it violates the "full faith and credit" clause of the US constitution...if you're married in one State...it MUST be recognized by ALL States.

i hope this issue goes to the Supreme Court so this can and will be legalized in ALL 50 States

RE: Appeals Court: Prop 8 unconstitutional - wvucrazed - 02-07-2012 01:26 PM

“Proposition 8 served no purpose, and had no effect, other than to lessen the status and human dignity of gays and lesbians in California.” - Federal Court Ruling

They are 100% correct. Minorities must be protected from the tyranny of the majority.

I suppose to a fundamentalist Christian like you, it isn't great news or the right decison.

civil rights aren't to be voted on...if they were woman wouldn't be able to vote...interracial marriage would be illegal...and the sodomy laws would still exist.

it's easy for 90% of the population (straight) to hold down the 10% (gay)

and before you complain those are rough numbers.

Yep. It's gonna happen. Very hard to argue how this is constitutional.

RE: Appeals Court: Prop 8 unconstitutional - Brookes Owl - 02-07-2012 01:31 PM

I'm shocked, shocked to find the 9th Circuit made this ruling.

Fine print: I voted against Prop 8 and think that government having a role in "marriage" is useless. Civil unions for everyone and benefits, etc. based on the CU. Marriage for those folks who choose, in the venue of their choosing, conducted by the officiant of their choosing, with NO legal entanglements necessary.

Now its clear you're an angry, gay black man...with an axe to grind. Get over it.

Actually it's quite simple. Far simpler than how killing a baby is legal. But, you don't like to think. It's far easier to pretend you know something from your simple-minded indoctrination.

Heh, right. No legal entanglements from marriage. Sorry Brookes, but the history of marriage is largely driven to eliminate legal entanglements and confusion (e.g., inheritance, succession, property rights, custodial rights...).

Your vision in this instance doesn't match well with history.

RE: Appeals Court: Prop 8 unconstitutional - RaiderATO - 02-07-2012 01:39 PM

Don't interpret any of this as for/against gay marriage, but:

-This would have gone to the Supreme Court no matter this court's opinion.
-I don't see a federal right to marriage.
-Not sure how it is a civil rights issue either.
-The govt. shouldn't have it's hand in the private lives of its citizens. (Shouldn't care who marries who, gay or straight).

Remove the tax incentives to marriage by eliminating the IRS, moving to a flat/FairTax and every other "benefit" to marriage/unions can be handled by a contract. Leave the word "marriage" to the churches. If one would like to grant marriages to same-sex couples, then good for them.

I'm looking forward to the SCOTUS ruling so we can have this settled. It can be debated like RvW, but at least we'll have the official legal ruling.

what if he is? (ant saying you are or aren't) he would have the same rights as everyone else...and that should include the right to marry the person you love, and enjoy all the government rights that come with it.

Tell me, how are you going to feel when gay marriage is the law of the land in all 50 states? Because that day is coming. Are you going to feel like the racists did when they were forced to open up their shops to black men and women? Are you gonna grind your teeth watching gays get married, like they had to when blacks were able to sit at the same counters they did, sit at the front of the bus, and go to the same colleges they did?

How are you gonna react to being part of the dustbin of history?

Best prepare yourself now.

there are only 2 fair options...

1 (and i think best) is to get government OUT of marriage...call it a civil union (for the rights) and let the churches decide who's married.

2 level the playing field so gay folks can marry just like their straight counterparts

The point is, he does have those same right. Exactly the same. Identically the same. Duh.

Nobody currently has that right.

Quote:and enjoy all the government rights that come with it.

W/o the obligations?

Sorry, "separate but equal" doesn't work. It's going to be marriage.
