Any attorneys on here can tell us if there is a case or not but I want to see the Big East not roll over and take all this from the other 5 leagues.

Well, I would think the dicovery process in a TCU lawsuit would be an excellent place to begin gathering evidence for an even larger interference case against the Big12. My guess is that the Big 12 never allows the case to make it to discovery.

Should the MWC & CUSA go after the BE for raiding their conferences?

Lawsuit says TCU never paid the exit fee needed, so they broke the rules and are being sued

The teams leaving CUSA and MWC followed all the necessary rules

Please try to keep up and pay attention and/or stop your lame attempt at trolling

Yep. Just pay up TCU.

Not trolling at all. If TCU agreed to pay the money, they need to pay the money. I was commenting on how some think the BE is not guilty of doing the same thing as the ACC, SEC and Big 12.

You're right JML. If the Big East wants to build a big case against conference raiding, then it doesn't have clean hands having raided C-USA twice.

But while one poster mentioned it, that's not the point of this lawsuit. This is a simple breach of contract case.

ACC stealing Pitt/SU in the middle of the night right before BE negotiating a big TV deal is certainly a cause for a huge lawsuit, especially if ESPN is involved and the new BE TV deal is less than what ESPN just offered last year. In some ways, I wish BE would sue ESPN because I love to see what kind of "advice" ESPN gave to the ACC before they raided the BE. We can put BCU AD on the stand and I would like to see how truthfully he can be under oath.
Now that would make for an epic ESPN 30 For 30 if it wasn't for the fact that ESPN was the one doing the damage.

The Big East probably did NOT want to file a lawsuit. It doesn't want to be thought of as the "ambulance-chasing" conference. So they waited several months for the check to arrive ... and it never arrived. Hence the suit.

By legal standards, this was not a long delay.

TCU better pay up - there may be interest on that $5 million.

Hopefully whatever money is paid by TCU, if any, plus the settlement from WVU goes to the schools and not just the conference office. I believe it was Rutgers who lost a home game when both schools elected to go elsewhere and wanted to be compensated.

Pitt did as well and should also be compensated leaving or not.

We won't know for awhile. UCF, Houston, SMU, and Memphis are still in CUSA.

Won't pay the exit fee till we are out, also CUSA exit fee is more than the $5 Mil TCU needs to pay.

Given that CUSA schools have more time to accumulate the fees, we should be ok.

Also TCU had to pay MWC exit fee and Big East contract breach fee.

I am sure it will be a topic of discussion at a President's meeting. It will be split between confence needs and going back to members who lost out. Big East does need to remarket themselves and maybe even a rebranding.

This ought to be very simple. After they joined, it should be clearly stated at which point such an exit fee becomes engaged and mandatory by the contract. Regardless if they played a game or not. If it's clear and applies, than TCU are trying to worm their way out... (Gee, I wonder who started the 'signed contracts don't mean anything' BS?) However, if the wording is unclear, then give up BE and write a better contract next time. I expect since the suit was filed, it's the former. And if so, really really bad form, Frogs. Glad we got the Mustangs and Coogs instead!!!!

apples and oranges. unlike wvu, the schools coming to the BE have honored/will honor their commitments to their old leagues

Ditto Cincinnati. Like Pitt they had to schedule 2 FCS games this year. They didn't lose a home game because they decided not to hit the road for a payday. They will lose money having an extra FCS team in town due to the low attendance.

It is part of TCU's plan to delay the 5 million payment which they contractually agreed to in hopes of working out a deal for a lesser sum.

RE: Huh, the BE is suing TCU?
There is no reason, the loss of TCU caused two open dates on anyone's schedule... Temple is replacing WVU on the schedule, meaning only the TCU date with everyone was lost.

That said, this legal document puts to rest, the question if they had a membership agreement or not, they did, and it spelled out a minimum of $5,000,000 to the Big East if you don't follow through. This appears to be a slam dunk case, if they have that signed agreement and footage of the TCU official publicly stating they'll have to make financial restitution to the BE.

May be they want this prior to the end of the academic year 6/30.

Personally, I think this is a stupid argument and this wouldn't be coming up if we had a real commish by now.

I believe beside the primary benefit of trying to get money from TCU it's serves a secondary purpose as a warning to SDSU and BSU in not thinking about backing out.

AND NO I AM NOT SAYING THAT BSU AND SDSU are backing out... just thought it might serve as a deterence if that should be an option.

Sorry Boys and Girls, I don't think the BE will ever see one red cent of TCU's "exit" fee because the BE was not the same conference when TCU made it's exit as it was when TCU was invited. This along with the fact that we never played one single game as a conference member. This would be a very hard sell to any judge or jury, IMO.

You guys need to face facts, the BE is no longer a major player and it's influence has fallen rather sharply and will continue to fall as other members depart. There are some great schools in the BE but collectively you are now rather disfunctional to say the least.

Too bad you signed the contract froggy. We know you need the money for attorney fees for your players drug ring trial but a deal is a deal. Pay up.
