RE: Vaccine lawsuit
Not at all an attorney, but a healthcare quality expert.
The vaccine is fundamentally/scientifically no different from any other vaccine, including the flu vaccine. It has been derived via a different method than many, but is hardly experimental. The flu vaccine or a mask at all times is a requirement for healthcare workers. Under a declared emergency, the CDC (iirc, through the atty gen??) has almost unlimited authority to do anything it thinks necessary to protect the population. As long as the CDC called for this under their emergency authority, it will be upheld. If you don't get a flu shot or wear a mask, you can't work in healthcare WITHOUT a pandemic.
The Nuremburg claim is scientifically inaccurate. I don't know if that is legally material, but I would suspect it is

RE: Vaccine lawsuit
I'm not sure how many mRNA engineered vaccines there currently are?
I'm also not sure what the long-term effects might be?
The extensive trials the article purports as proof of the vaccines safety should have been used by the tobacco industry.
I've had two injections of the AZ vaccine, but I'm pretty much past my usefulness so no real loss to society if I'm pushing up daisies sooner than previously projected.

The only one out there is the one for MERS iirc. MERS died out so the Phase 3 trials never went forward.
This is one reason why the Covid vaccine got to where it is so quickly, as a whole boatload of the 'how to do it' came about with MERS, and MERS is a cousin-type virus of the current scourge.

RE: Vaccine lawsuit
the above conversation though may be misconstrued about the usage and function of vaccines.... While not scientifically accurate, this is a pretty clear way to think about it.
mRNA speaks to how we develop the 'thing' that is put into our bodies. It's a bit like speaking about whether a breast implant is made by injection molding or some other process. The process by which it is made makes ZERO difference to its impact on the body. I think a lot of people think that because we are dealing with the messenger RNA of a virus, that it will/could have an impact on OUR mRNA... and that is misleading.
What impacts the body is that we are putting something 'foreign' into the body in order to create a natural reaction... a SPECIFIC reaction by the immune system that has been scientifically determined to improve the body's ability to fight a specific disease. It is fundamentally (though not completely scientifically) no different from introducing anything else into the body.
When this 'thing' is introduced into the body, the immune system NATURALLY reacts in a way that would also be effective in response to the covid virus being introduced into the body.... sort of like practicing a play before you run it in a game.... so that the body is better able to fight the disease because it already knows how to respond.
ANY time a foreign body of any size (and this is INCREDIBLY small) the body has a reaction. SOMETIMES, that reaction can be significant and even damaging... but the risks of complication are very low in no small part but because what is being injected is not living, nor is it 'ongoing' like smoking. MOST of the complications are no different from any other injection.
This is entirely different from ingesting a medication, which is often essentially putting something in your body that is DESIGNED to kill something (antibiotics as an example), and hoping that it doesn't kill anything else or kill too much. Vaccines are not designed to kill anything.
I'm not saying that the vaccine is 100% effective (effectiveness has not entered into the equation above) NOR that it is 100% safe (nothing is). What I'm saying is simply that everything has some risk... BREATHING or DRINKING WATER has some risk.... and despite millions dying from things they've inhaled or ingested, we ALL do it every single day
If you (anyone) doesn't want to take the shot, I have absolutely no issue with that. I don't remotely think such things should be mandatory or required for travel or whatever else. I think we should study whether we need to offer vaccinations to people as they get older (the lack of viral load in children) or if they need to be updated whatever... but if you don't want it, you CAN'T (imo, legally) be forced to endure medical treatment... no matter the consequences... since those who are concerned or are at risk CAN have access to a very effective vaccine. If you want to smoke and die from lung cancer, we don't stop you.

RE: Vaccine lawsuit
Is it weird that this right-wing attorney is arguing against the ability of a private company to run its business as it sees fit? Doesn't that go against conservative principles?

Not at all.
Most conservatives I know believe in the power of conservative principles as they apply to individuals, including how they interact with companies.
I think you're reacting to how many liberals describe what drives many conservatives, and not what many conservatives tell you.
I've never heard one conservative who puts corporate rights above those of the individual.... we just don't draw the lines in the same places that liberals do in those areas where those rights conflict.
And more to this specific issue, you generally can't operate in a healthcare situation that doesn't follow government rules, otherwise they AT LEAST won't pay you and AT WORST will put you in jail or help people sue you. And they're the biggest payer with the most legal power of any entity in the country... so effectively the company is acting at the behest of the government.

RE: Vaccine lawsuit
I received 6 calls from the CDC asking about my position on COVID vaccines etc etc... so we're spending BILLIONS on this... and this is a big part of what I do for a living.
Based on the questions they asked, they clearly don't have the foggiest idea on what motivates people to eschew things like vaccines. If they did, they'd do a better job of addressing those issues and closing the care gaps
In the best example, there is an ad featuring Spike Lee in an urban setting talking about 'this is 'our' vaccine'. Clearly they think that seeing a media mogul (or a president) do something will influence people to do it... and there IS a segment of the population for which this is the case... but generally speaking, this is not the religious right, the anti-media culture right or the conservative right. It is, by and large... people who TRUST government and are going to get the vaccine anyway.
What the left doesn't seem to understand about (as an easier example) seeing Trump wear a mask is that (and I've said it 100 times)... There are people who dislike Trump SO MUCH that they would be tempted to go against their own best advice if he echoed it. One of you guys on here admitted so. ALMOST NONE of those who support Trump would do so because it directly conflicts with why they like him. The evidence is right here, with your perspective on a right-wing attorney being 'against' a company and thus in your mind, against conservative values.
So the people most likely to trust and follow the government under Biden, would NOT have trusted and followed Trump... and those who trusted and followed Trump would NOT have trusted and followed 'the government', even with him as the leader of it... if it conflicted with individual liberty.

I guess I associate what you are saying with more of a libertarian approach than a Republican one.

Are the mandates of employment law applied differently for private hospital systems because they generate some of their revenue from federal programs such as Medicare? Are they held to a different standard WRT employment practices than other private companies?
What if healthcare companies don't accept government insurance? Private urgent care centers/surgery centers/free-standing hospitals, etc. Would they be able to demand that their employees receive the vaccine?

I don't follow. Somebody on here suggested that he would be likely to eschew mask wear (even if he believed in it) if Trump had come out and supported the universal use of masks? I don't remember that.
Are you saying that if Trump had come out and said "Hey, it's super important to use masks all of the time. Let's make this happen" that almost none of his supporters would have gotten behind that idea? I don't agree if that's what you're saying.

Again... not sure that I agree with that when it comes to masks.

I think they run a gamut. Yes, Trumpista types are in there to a good deal; but at least here in Austin the 'natural whole grain' types are in the same boat. And, I dont think political bent can really describe the very real proportion of health care professionals that are 'anti-covid-vax'.
My belief is that your "anti-vaxxers overlap CONSIDERABLY with the anti-media culture right" is painting with a horribly wide brush.

What proportion of medical doctors are "anti-covid-vax"? I'm sure that they exist however I've never met one or seen one on TV. I would guess that the % of "anti-covid-vax" medical doctors is well south of 5%.
Now if you want to include chiropractors, etc in the "health care professionals" group then I will grant you that you will find some anti-vaxxers there.

I wouldnt take that as considerable overlap. You left that group out as the only main ones *you* could think of, surprise surprise. I think there are a lot more to be mentioned in addition to. Imagine that.

Not necessarily, but coming from you I take it you mean it as such. Perhaps you have warm fuzzy feelings for the group that you have never shared with us.

I wouldnt take that as considerable overlap. You left that group out as the only main ones *you* could think of, surprise surprise. I think there are a lot more to be mentioned in addition to. Imagine that.
I said there was considerable overlap. I didn't say they were the only anti-vaxxer group. I didn't provide a list of all the anti-vaxxer groups that I could come up with and nobody asked me for an exhaustive list.
Remember when I said in post#12: " I didn't say "all MAGA-hatters are anti-vaxxers". Nor did I say "All anti-vaxxers are MAGA-hatters""?

My comment wasnt negating that. It *was* negating your predisposition that most anti-vaxxers are ignorant anti-media culture right, as you seemingly imply. Actually, you dont imply that at all, do you?
Those are your pejorative words, not mine. I suggested that that there was overlap with anti-vaxxers and the anti-media cultural right. Nobody said anything about ignorant. Does anti-media cultural right = ignorant to you?
Not necessarily, but coming from you I take it you mean it as such. Perhaps you have warm fuzzy feelings for the group that you have never shared with us.
I think you ascribe all the terrible traits of leftists to those of us that post on this board (which really isn't fair, IMO). I wouldn't use the "ignorant" brush to paint all anti-media Trump supporters as (like I have said in the past) plenty of my family (who I happen to love) falls into this category.

You actually say "THERE IS A GOOD DEAL OF OVERLAP".
I say "I THINK THAT WHILE THERE IS AT LEAST SOME THERE IS LESS THAN YOU SEEMINGLY THINK OVERALL".

You just decided to leave it at your combination of 'considerable overlap' *and* abjectly not naming any other type of group. Got it.

Im using other somewhat snide comments you have made about Trump supporters earlier in my assessment. Not just limited to this one, good sir. I wouldnt get too worked up over it if I were you.

So when I say that there is considerable overlap between two groups then I must list all other groups that may ALSO overlap or else the assumption is that I believe (one group) = (the other group)?
Seems ridiculous to me. Definitely not worth a late-night argument. Good night.
