I'll take your word for it, that second half of paragraph two was about as sideways written as I could imagine. Sounds like a pre-empt cover our asses to me.

And yes, when I read that I likely did conflate "discipline" with "prosecute". Though I was thinking about the bureaucratic morass that is, not whether they could face charges of one kind or another.

Wonder if the Homey has booked his next flight to the tall trees yet.

That is just incredibly weird. Never heard of anything like that happening before.

My hunch is that Sullivan wants to unload some candid/blunt political opinions, but is leery to have them go out over his personal signature since he is supposedly “impartial” (which is bullsh¡t, of course, but for now everyone is supposed to officially play along). So he he has hired a lawyer to say these things for him.

Sullivan’s problem (one of them, anyway) is that the Appellate judges can deduce that strategy just as well as anyone else. They may — or may not — permit an attorney to enter the case on a judge’s behalf. We shall see. But even if they do, it won’t change the end-game.

Who really cares about his opinion? He has to know this won’t look good in any shape matter or form. Flynn will still be off the hook. The taxpayers will still foot the bill for a huge settlement and this idiot judge will still have called him a traitor.
What this tells me is the length to which the sycophants will go to try and cover for Barry. Why? Is it just the race thing?

My complete understanding is that as a judge if the case is dropped, his job is done, but with him asking for others to weigh in he exercised authority he didn't have.

The way I read the order from the Fed Circuit is that Sullivan must sign the response. *He* is being ordered to respond --- the order dictates that *he* respond.

My guess is that he has hired the lawyer for one of two reasons: a) ghost write the response that Sullivan reviews, edits, and signs; or b) be the 'backstop' that Sullivan sends his work to for 'lets not piss off the Federal Circuit panel' review --- and perhaps a bit of a) above.

If a lawyer writes the response, and signs that response, it doesnt matter who signed it -- they are deemed the words of Sullivan. Hiring a lawyer to do your trash talk wont insulate Sullivan from 'political opinion' in the response.

It wouldnt necessarily work for a layperson, but in no way. shape, or form would it act as an insulation for a sitting Federal judge. You can excuse a layperson for a lawyer 'screech' in response -- you really cannot extend that same courtesy to a Federal judge.

The basic rule is that the client has the authority to dictate both the content and the tone of the response to a court. When the client *is* a sitting Federal judge, the court reviewing the response will treat every word as that of the judge in front of them --- when the judge knows the fundamental rule that the lawyer *must* present and allow the client to review, and when that client is a judge who knows precisely and deeply what the issues are --- an appellate panel will not let a political screed be pawned off on the authoring attorney.

Any judge who hires an outside private attorney to write his or her statement of rationale for actions taken during a matter is de facto not qualified for the bench they occupy.
