Just saw this about a lawsuit led by Ohio to get a temporary restraining order against the NCAA for the transfer rule blockages this year. Hope this frees up Jamille Reynolds sooner rather than later.
I like it but I do wonder if suits like this are just another nudge towards the Big Split and collective bargaining/unionization.

What is the legal difference between regulating rosters based on level of pay versus regulating rosters based on who the previous employer was?

Nothing. They're almost identical issues. If the NCAA can't regulate the one, then they can't regulate the other.
The NCAA is going to be left governing no revenue sports and whomever is left after the SEC and B10 soon decide they want their own governing body and rules for the college pro league.
