I'm actually with Rubio on this... (and anyone who's opposed to declaring this nat'l emergency). Don't think it's needed and that's a mountain that I don't want to have to deal with in the future.

I was not a fan when Obama did it, nor will i be a fan if Trump decides to do it.

It only counts if you vote against Trump on significant issues, little Marco Rubio . He'll do nothing. No, this doesn't give him any moral clarity to criticize a Dem for seizing AR-15s and clones and shutting down gun sales for a year using national emergency powers. What he could do is walk over to the Senate well and sign a discharge petition.

If any of you think Trump not declaring a National Emergency to build a border wall will keep the next Dem. president from declaring one on climate change you aren't paying attention and are very naive. That will happen during the first year of the next Dem President's tenure whether Trump does this or not.

what I find amusing is that people don't think they would jump at the opportunity to use it regardless what DJT does....

they've already succeeded in appointing judges that legislate from the bench....

A couple of thoughts...

a) it's not a precedent, if a Dem POTUS wanted to do it he wouldn't need to point to this, there have been scores of national emergencies declared.
b) not declaring the border an emergency would have NO impact on a future decision by a president to declare any emergency, or at least it shouldn't. Each decision should be evaluated on its own.
c) I like Rubio, but his opinion here is not particularly important

Other than Obama, I would prefer (and would like to believe), unless a total govt-socialist candidate makes it to the Presidency, they'd be a bit more cautious than doing it, Eagle, because the dam hasn't been "broken" yet (although it's had a few cracks showing).

Maybe I'm just an optimist in that regard.

Guys, if you don't think Trump doing this will set a precedent, you're dreaming. The Dems are openly calling for a national emergency on health care, the environment, education, gun control, redistricting, campaign finance (foreign influence), etc.

Remember, national emergencies usually are about either the arcane or the universally popular. Until Trump. Trump wants to use them, then good luck to you, because you're losing in 2020.

Heck, President Elizabeth Warren could use them in order to protect House and Senate Dems from having to vote on issues that might hurt their reelection prospects.

There is nothing stopping a democrat from doing this as soon as they become president. This is the law NOW. If you dont want them to have that ability, you need to pass a law that REMOVES that ability.

This isnt some sort of pinky-swear that if Trump doesnt do it, the democrats won use it. Its the law. If you dont want it to happen, you have to change the law.

This. What the media and they left are saying now is "THEY" will be the party of tyranny when they get the White House. Trump is willing to do something in which there is evidence of people dying and tens of billions of dollars are being spent because people are coming here illegally. Not to mention the money is already allocated in the budget and will negatively effect absolutely zero citizens of this country.

Face it Tom, the Dems are all for any way they can increase the power of government..........everything they aren't presently getting is now "a crisis". Just like when the 3 year old doesn't get Hostess Cupcakes at the grocery and does a floor tantrum - that is now the Democrat response when they don't get everything they want.

Elizabeth Warren won't be the President in 2021 any more than Hillary won Georgia or Texas......remember that?

It has been a national emergency for decades. If Americans knew how many other Americans have been killed by illegals they would be stunned.

Its a terrible precedent over a petty issue.
