The threatened NonBCS monopoly lawsuit against BCS should also include a civil rights component, which, in fact, might be as strong or stronger than the monopoly question. The college experience is supposed to include athletic competition, given the many statements made by NonBCS and BCS College Presidents. The BCS's actions are detrimental to this aspect in two ways. First, BCS is not allow students and athletes in NonBCS to have this experience. Second, B12 Commish is now saying some athletes may get excluded all together because of financial limitiations (imposed by BCS, of course!) and not have a collegiate athletic competition experience.

All this because college sports within a university has assumed a life o its own so it can pay its football coaches $3/$5 million and the Athletic Directors $500,00+.....this is what is driving BCS within its members. Wonder how much those colleges pay their physics, math, and engineering profs?

At this point, having lost every attempt to gain a more equitable position, NonBCS should first threaten a monopoly &/or civil rights suit against BCS...but first try to get BCS to the negotiation table. If efforts fail here, then proceed with the lawsuit.

Any G5 suit against the P5 would be beyond idiotic. Really, forgot the legal issues and pretend like the G5 won and the court ruled that all NCAA FBS conferences had to have a stronger chance at the national championship and/or equal money (or more equal money). What would be the result of that?

The result would almost certainly be the power 5 forming their own set-up to that would be separate from the NCAA or NAIA (the NAIA is a different organization that some schools are in rather than the NCAA). Really, imagine how they could set this up. Let's call it the CAA (College Athletic Association)

1. The CAA could set-up 4 divisions.
2. The Power 5 would set themselves be in division 1 to start and could make a rule that every new member to division 1 would have to approved by a majority vote from all members.
3. They could then invite any NCAA member they wanted to join division 2, 3, and 4. (It's up to those schools to come or not)
4. The CAA tournament could be a combined division 1 and 2 and be 68 teams if desired.
5. Division 1 itself would be small and the G5 wouldn't be in it (they'd be division 2)
6. Division 1 could set up a rule that allowed as many as 3/4 games vs. division 2 (which would include a lot of current G5).

In short, they could largely replace the NCAA with a new voluntary organization they created and with a set-up they approve of. Now not all NCAA members would join, but I think most of division 1 would. The only reason we haven't gone here is the P5 legitiately don't want to push the G5 down.

I would be willing to bet that UConn and Cincy would have nothing to do with this idea.
You can't file a lawsuit just for them breaking away. You could only file a lawsuit if the breakaway engaged in anticompetitive behavior and you were damaged by it.

Man I did not know my Civil Rights were violated...... because "the college experience is suppose to include athletic competetion" and they would not let me play on any of the athletic teams.

How ridiculous can it get.
Poor P5 conferences. Hard to believe what he said.

"I think all of that in the end will cause programs to be eliminated. I think you'll see men's Olympic sports go away as a result of the new funding challenges that are coming down the pike," he said.

Those that say a lawsuit would have no effect would have other things to say if the rest of college athletics
received something like a trillion dollar judgment. Nothing is permanent in life. Even the good life.
Hope common sense prevails though, lawsuits mainly make attorneys money.

I agree with most of this except the BCS WAS modified multiple times during its run. Some were minor tweaks like modifying the components of the computer models. Some where major like adding an additional BCS bowl and building in new rules for non-AQ access. If everyone wanted to expand to an 8 team playoff, the 6 year mark would be the ideal spot to make some renovations to the current plan.
