On BBC America last night, there was a story of two people who lived in a assisted living facility (man and woman). The woman's husband did not live at the facility. Both the woman and the man (living in the facility) have dementia. They were "caught" have sex twice. The woman called her "in-house lover" by her husband's first name. So, the question is, is this act rape, consensual sex, or I don't know wtf just happened. Both the woman and the man are very happy, just not consistently aware of what's been happening. I do smell a big, fat civil lawsuit against the facility, but beyond that, I'm as lost as the two involved parties.

perhaps the male in the facility is preying on her dementia to get a little late night hanky panky02-13-banana

That would be a cool plan, but he's got dementia too (or, at least he was diagnosed with same---maybe a kickback to the doctor?).
