WVU attorneys pressed Clawges to fast-track the West Virginia lawsuit, saying the university needs a resolution by June 30.

“We need to know whether we’re going to stay or go,” said WVU lawyer Stephen LaCagnin.

“My immediate reaction is ... it ain’t gonna happen,” the judge said.

Clawges agreed to an aggressive schedule for the West Virginia case but told the attorneys it will be up to them to make it happen. He also noted it could end with a settlement before ever getting to a jury.

WVU said it will reply to the Big East’s motion to dismiss by Dec. 9, and Clawges has scheduled a hearing on the motions for 1 p.m. Dec. 19 in Morgantown. He may rule from the bench that day.

The trial is tentatively set for June 25, 2012.
Is it possible for WVU just to say F it and leave the Big East before the trial date and not reaching a settlement with the Big East? If I was the Big East I wouldn't even discuss a settlement with WVU and wait till the trial is concluded.
Well it looks like WVU isn't playing in the Big 12 next season.
That remains to be seen, cinbin. WVU may very well just leave, and let this play out in the courts afterward, if they feel strong enough in their position. There is a precident...

I have no idea what's going to happen. But it's going to be interesting watching it play out...

I do not know of a precedent for that. But I woudl imagine if they tried that they would quickly be lsapped with an injuction and prevented from playing in the Big XII. The court could not techncially stop them from leaving the Big East, but they could most certainly stop them from playing in the Big XII.

This would be the equivalent of if Carson Palmer, when the Bengals would not trade him or cut him, tried to just show up at Oakland and start playing. Palmer could have given all of the reasons in the world of why he thinks the Bengals did not treat him right, or were run poorly, or anythign else, but under no circumstances would he have been allowed to simply play for another team. His only recourse was to simplynot play. And it is the same thing you see in the NFL when someone wantsd a new contract or out of thei rold one: their only recourse is to sit out: they cannot just go play for another team.

This is the same situation.
And then how long will the appeal process take after that trial date....?
Knowing what I know about these lawsuit processes, WVU will be in the BE unless BE let them off the hook. If WVU does leave without any permission, the amount of damage could be huge and that's assuming the court could not force WVU to stay.

Either way, I really don't care what WVU does at this point. I just want them to pay up and leave. Damage to remaining school's schedules, BCS points etc. could be enormous and WVU better start raising that cash now.
If the Big XII invites Louisville, the conference by-laws essentially renders the conference nonexistant (football only). If half the conference decides to leave The BEast, there suddenly becomes no conference left to sue WVU...

Not if a judge issues an injunction, and judges don't typically like it when one party tries to ignore the legal process ...

How so? Louisville would be held to the same 27 month notice as the rest. Also i know some would like to ignore it, the BE does have schools that DONT play FB. Anyone wanting ot leave the BE AHTLETIC Conference would still need to honor their commitment to those teams left behind, FB playing or not
Wouldn't it make sense to at least hold them to the contract and in the conference until the new schools are added?

Once the New Big East is 100% finalized, I wouldn't care if WVU won the NC or became 1-AA.

Does anyone know the court where everything was filed? At least which state the lawsuits were filed in? I have a PACER login (Public Access to Court Electronic Records) that I signed up for with the ESPN vs. C-USA lawsuit. Only cost is a few cents per page of each document filed as you access them. If I can get that info, I should be able to download & post relevant items.

WV filed in WV, Big East filed in Rhode Island.

WV just filed a petition in the RI court asking it to recognize the WV court's jurisdiction and dismiss the RI case.
Didn't The BEast file a petition in the WV court asking it to recognize the RI court's jurisdiction and dismiss the WVU case?

Not yet, but the Big East has announced that it will file a motion in WV court this Monday asking it to recognize the RI court's jurisdiction.

Personally, I'd like to see WV be allowed to do what they want, play in the Big 12 starting this fall, but after paying a hefty buyout. All the parties should be doing right now is negotiating that buyout. Make it big, but let WV pay it in installments over several years if they want, and make it payable directly to current Big East schools should the Big East dissolve in the meantime ....
The folks in charge at WVU have made it clear they intend to begin Big XII play next season. The BEast isn't planning to let that happen, since it would set a precident Pitt and Syracuse could use to leave early as well...
Although I agree that all three schools should be allowed to leave as soon as possible, I understand why many don't want them to leave immediately. Simply, the Big East front office sucks. Expansion should have been handled years ago and now in crunch time, they cannot get their act together, much like they weren't able to do over the last several years.

I think the three schools are around one more year to fill next season's schedule and they pay nice buyout to get out for 2013. Just a guess, but the longer the Big East takes to fill out a conference, the longer they need the three teams to remain.
