I've heard that TCU will still have to pay the $5 million exit fee, but, of course, won't be tied to the 27-month waiting period.

I would argue that if a school agreed to join a conference, but before they got there 25% of the schools in the conference left it, they have at least a moral argument that they shouldn't have to pay it. It's probably not a legal argument, however, but it's kinda sad that saying Yes to 8 schools a few months ago means now paying 6 schools a ton of money. TCU cannot be blamed for this mess.

Unless there is a specific "out clause", my assumption is that TCU will have to pay the $5 million. That is the chance they took by joining the Big East. They knew it up front.

My guess is that TCU will write that check and there will be no extended negotiations or lots of discussion about it.
Pretty sure all TCU would have to do in a court case is call Marinatto to the stand and that would be case closed. Judge would throw out the exit fee on the grounds of Big East false misrepresentation of having a Conference that cared about Football
I don't think we'll fight it. We negotiated out the 27 month clause, but kept in the 5 million in the agreement; no reason to go back on that now.

I have been a litigator for almost 25 years. I think that TCU owes the money to the Big East, period.

TCU did not join the conference for "football". It joined for all sports.

Unless there is an out clause, TCU will write that check, probably swiftly and gladly.

Nobody held a gun to their head and made them join the Big East. Having said that, I would not make them pay an exit fee since they were not really in the conference.
If someone wants to argue that we pay less, by all means do so.

In the meantime, we're writing the check for the full $5 million.

Why no 27 month waiting period? Just wondering.
The BB schools are looking at their final big payday from the FB schools.
Temple better take note before signing.
