If it were someone other than Kevin Fell, I might be somewhere in the ballpark of sympathetic. But he's a jerk and always has been.
What about when Ball St. had the St. Louis Cardinal on their helmets...did they pay roalties to St. Louis?

Or Kent State when they had the same helmets as San Diego a few years back.

Didn't OU have that paw mark that Clemson has on their helmet a couple years ago?

I'm not passing judgment here...just askin'

I'm sure there are hundreds of examples.

Mentor and Cardinal Mooney High Schools in Ohio also had the St. Louis Cardinal. My own high school had that Clemson Paw Mark on their helmets. My son's High School has the Washington Redskins speer on their's.


Personally, I think that in these days of computers, a coach or AD can come up with their own letter or helmet design.

But I guess they should copywright it, unless they don't mind being ripped off.


Didn't Major League Baseball at one time want to start charging fees to little leagues across the country, but backed off after all the bad PR?
What about the University of Georgia and the Green Bay Packers? Same logo. How does that work out?

I've also always wondered about Michigan's helmets. I would've thought that they had the 'winged helmet' copyrighted, but apparently not. I believe the University of Delaware has the same helmet along with numerous other high school teams.

Nothing wrong at all with what Wisconsin and Ball State are doing, they have every rite to protect themselves.

Now here's another one.......my grade school had the Ohio State fight song as it's fight song (music only, different words) and my high school had the Minnesota fight song (same thing). How can they get away with that?

They do. But in response to Photodan, it's unclear that the changes they made were "inconsequential". That is precisely the crux of the debate.

Trademarks and copyrights are different. Copyrights expire after a certain number of years. (Which has been extended to ridiculous times thanks to Disney) Anyway, if the copyright expired, or wasn't renewed properly, then the song may be public domain.

Possibly the same thing happened w/ the Green Bay/Georgia logo. Those were developed in a different era, when such things weren't done w/ such rigor.

The winged design used by Michigan was originally started by Princeton and brought to Michigan were it was popularized.

Green Bay and Georgia share that "G" logo, as I believe there is still not enough evidence on either side to prove where was first started/ used and I think they came to an agreement to share the logo instead of drag the whole legal thing out. By the way Grambling also uses this logo.
I've seen at least two schools that use an exact duplicate of the Toledo Rocket logo. One is in Ohio (near Kent State), the other in Nebraska.

what about all the High schools in Ohio that rip off OSU's Fightsong as their own???
The fight songs are a non-issue because the schools purchase the sheet music and thus pay royalties on it.

I don't think A&M owns the rights to that song anyway, just like OU doesn't own the rights to its song.

a quick google search had at least 6 different schools using UT's logo. That was before I got bored and stopped looking. Also while waiting for a flight home from Portland over the summer I heard there was a Toledo high school in the West somewhere that uses the Toledo part of the logo also.

I believe it's directly on point. I have made what amounts to the same amount of modification to the logo.

Explain how it is a bad analogy.
