Surviving a motion to dismiss only because the judge gives you the opportunity to redraft your complaint allows of two possibilities, either the complaint lacks merit or it was poorly drafted. Either way, it’s hardly a good sign for FSU.

As the topic of the thread is Atlanta attorney Doug Rohan's takes on things, here's his immediate reaction.

Perhaps the State of Florida can fly their AG to Charlotte, if she can get permission to view the document.

If the document were in Florida it might be a "public record" under Florida law, but the document is not in Florida.

How can it be a Florida public record if no one in Florida has custody of the record in question?

FSU can ask to get it in discovery but they're still trying to prove that a Florida court has jurisdiction over the matter so discovery is a little premature. Even if there is jurisdiction, the ACC has every right to insist on a protective order preventing its disclosure because it's a trade secret.

I would say that FSU seems to be trying to ratchet up their nuisance value in hopes that this forces the ACC to negotiate but this is an existential thing for the ACC. Settle it on terms that FSU can live with and the ACC rapidly falls apart, something that FSU and its fans can't seem to understand.

The FSU lawyers are taking on water (rapidly) and they are now trying to throw any 01-rivals against the wall that they can find to keep from sinking faster.

FSU is not getting their money's worth from their legal team.

The politics in Florida are all performative - yell and scream like various apes and monkeys so as to signal others of your tribe. No one in NC is even obligated to respond to her as far as I can tell.

Isn't that the truth? I expected better. Maybe that's the real problem, maybe we the ACC expected something that was beyond their capabilities.

Maybe in two or three years.

If I understand correctly (and IANAL): since the window for appealing to Federal Court has apparently passed, the only way it can go to Federal Court now is if the 2 states come down with contradictory decisions - which means BOTH lawsuits must finish.
