Oh well. That was a self inflicted wound by making it personal. Good choice to not call the media, as he would have looked like a tool, er fool.

I mean the student shouldn't have gotten any punishment for what he said, but that's not because he should be allowed to say whatever he wants.

The fact that schools can limit what people say on school grounds is exactly why Ron DeSantis is able to tell teachers they can't discuss how awesome being gay and trans is with the kids. It's why students can be blocked from having a trans pride club. It's why schools can mandate dress codes.

We sued the local school board because they suspended my step-son for a facebook post. We lost.

You are confusing an employer limiting what employees can say/do with what students can say. The school may be able to limit the kinds of clubs they allow. However, I'm pretty sure that courts have not ruled that students lose their first amendment rights when they walk in the door of the school, with certain exceptions (threatening others, etc.)

Where's Tanq when you need him? There are other lawyers on the board. I wish one would weigh in on this.

lol some of you are insane. What school did you attend where you were allowed to say/wear whatever you wanted and the school couldn't stop you.

This goes both ways too. I wouldn't want the school allowing a pro drugs gathering on school grounds or a pro drug club. etc.

That being said the state should step in and not allow the student to be punished for this.
