You're looking at a political system when you're looking at the Russian criminal justice system. The two can be indistinguishable. That's not something that you or I should respect. The United States does have a duty to US citizens who find themselves incarcerated under those types of systems. You just don't sit back and go 'well what she did was illegal under Russian law and the Russian judicial system' .. that's said I'm still not sure that we should make any kind of trade. Especially the kinds that have been suggested. This just encourages more bad behavior on the part of the Russians.
Ummm if a Russian citizen came here and broke a US law, would they not be held accountable by US legal standards (or at least what they used to be back in the 20-teens?).
To make the point
Let's pick on two "crimes" and both countries.
Crime 1: Illegal Drugs
- A Russian comes to the US with a vile of Cocaine - gets caught and the punishment in the US is 3 years in Prison
- An American goes to Russia with the same payload, but In Russia that is a 20 year prison sentence
Crime 2: Prostitution
- A Russian woman decides to sell some love in the US and get's caught. In the US that is a 10 year prison sentence
- An America woman decides she want's to get paid for the Russian DipStick and get's caught. In Russia that is 6 months in the slammer.
Are you are basically saying in Crime 1we should not respect Russian law simply because it is treated more severely than the same thing in the US?
I can only assume in Case 2, you disagree with US rule of law because it is more harsh than the way Russia handles it?
I do see your confusion however, now that penalties for laws broken in our country seem to be highly negotiable these days, you think that should also apply across the globe.
In this case (Griner) if Russia handles every case similarly - she can rot for the next 9 years like the rest of the same offenders. If she was treated differently (AKA - politically) that is a much different story.
