They filed for arbitration after they released schedules after being told numerous times not to include the 3.

So if all 3 schools have sovereign immunity how in the world would arbitration in TX even be successful? Even if it was signed, doesn't seem like a state/commonwealth school would be bound by the contract or at least on the arbitration side of it.

The arbitration is likely binding and would be the activity that would do the injunction. The demand for arbitration opened the door for the schools to file a suit. That is likely why CUSA delayed talks. Now everyone has to play their card hand. My guess is that CUSA hoped the SBC would back off early admission. If that is true they should be looking to end this now. Still likely to see them make an effort for a dismissal.

Controlling the venue is important. suing in their own state is a good move, plus it means C-USA has to split their legal resources fighting cases in WV, VA, and MS?

The UAB example is the most relatable here. There was a clear violation of bylaws that was ignored and it scrambled football scheduling, but CUSA adapted and rearranged schedules to accommodate.

I remain dumbfounded by Coosa s course of action. Clearly the bridges have been burned between the SB3 and Coosa. Why would you try to force them to stay?
