I have been very clear about Hillary's situation. Her actions, and/or those of her staff for which she was responsible, clearly satisfied all the requisite elements of several crimes, including national security violations, obstruction of justice, and perjury. Comey recited all those elements in his official statements and congressional testimony, but recommended not prosecuting because of difficulty proving intent. However, intent is not a requisite element of several of the national security crimes; moreover, two primary indicia of intent, repetition and destruction of evidence, are clearly present in her actions and those of her staff. I can see a decision not to prosecute as an exercise of prosecutorial discretion, since any trial would have been before a civilian jury and I have seen the difficulties of explaining national security law to others not familiar with its provisions, both here and in social settings. But that was Loretta Lynch's call, not Comey's, and she was in something of a bind because her tarmac meeting with Bill had come to light. My best explanation of what happened is that the fix was in, and Comey got to be the messenger boy with the establishment agreeing to give him cover. There is simply no other explanation that fits the facts. And note that Comey never stated anything to the effect that Hilary had not committed crimes. He just recommended not prosecuting those crimes.

Let me put Hillary's actions in perspective. Suppose there was something on her server about the plans and whereabouts of our ambassador to Libya (very likely). And suppose that it is determined that such information was hacked prior to the killing of said ambassador (possible, but unlikely that we would be able to determine this). Then her actions arguably constitute a capital offense.
