To protect us from libturd state fuehrers.

Connecticut assault victim gets 18 months in jail for stabbing attacker

Sumpter was working at a Dunkin’ Donuts in Norwalk last October when he was jumped by three males. During the assault, Sumpter stabbed one of them in the leg.

“I was defending myself,” Sumpter said during the hearing.

Judge John Blawie told Sumpter that he believed his version of events, but had to follow the letter of the law.

Under Connecticut law, assault victims cannot use deadly force if they are able to retreat from their attackers.

Will black lives matter be involved in any protests?

Fox News left out this part which is why the judge had to do it.

Quote:Sumpter, dressed in a white prison jumpsuit with short sleeves, did not reply. His public defender Howard Ehring said unlike a state like Florida, which has a law allowing its residents to stand their ground, Connecticut law requires Sumpter to retreat from the beating he was given at the Dunkin’ Donuts where he worked. After being assaulted inside the coffee shop, Sumpter ran outside and stabbed one of the men

If I was the judge, I'd have given him probation though.

RE: This is why we have stand your ground laws
Give me a break! I'll need to assume I can first get away from my three attackers before I can try to defend myself with deadly force! By the way, what constitutes deadly force while in the act of trying to defend myself if I assume I can retreat from my three attackers? See how this is illogical when you have seconds to make a decision? Here are the states with stand your ground laws (thank you North Carolina Legislature):

Quote:Here are the states that have passed stand your ground laws:

Alabama
Alaska
Arizona
Florida
Georgia
Indiana
Kansas
Kentucky
Louisiana
Michigan
Mississippi
Montana
Nevada
New Hampshire
North Carolina
Ohio
Oklahoma
Pennsylvania
South Carolina
South Dakota
Tennessee
Texas
Utah
West Virginia

Note: Some states have adopted stand your ground-like doctrines through judicial interpretation of their self-defense laws -- but they are not included on this list.

Some states have self-defense laws on the books that are similar to stand your ground laws, often with at least one key difference. These laws generally apply only to the home or other real property (such as an office) and are often referred to as "castle doctrine" or "defense of habitation" laws. Most U.S. states have castle doctrine laws, including California, Illinois, Iowa, Oregon, and Washington.

Duty to Retreat States

On the other end of the legal spectrum, some states have laws imposing a duty to retreat. A duty to retreat generally means that you can't resort to deadly force in self-defense if you can safely avoid the risk of harm or death (by running away, for example). If that is not an option, say if you were cornered or pinned down and facing serious harm or death, then you would be authorized to use deadly force in self defense. The following states impose some form of duty to retreat before using deadly self defense:

Arkansas
Connecticut
Delaware
Hawaii
Iowa
Maine
Maryland
Massachusetts
Missouri
Minnesota
Nebraska
New Jersey
New York
North Dakota
Rhode Island
Wisconsin
Wyoming

Note: Some states with castle doctrine laws also include a limited duty to retreat (like if simply going into your house and locking the doors is sufficient for self-defense).

From what I read, the assault spilled to the outside and thus the State viewed he and the duty to retreat. Had the assault not spilled outside he would have not been in any legal trouble

Maybe he ran outside to run home or get into his car and leave. I would need to read much more testimony. Maybe they came after when was outside also IDK.

RE: This is why we have stand your ground laws
That's still not (in my mind) an SYG issue.

If he did what was described... if the assault is over (they are attempting to leave the scene) and he follows after them.... then he's not standing his ground or defending himself. If in the process of the attack, the fight moves outside the door, then he is still defending himself. HE PERSONALLY was being attacked it seems, and not a home or business invasion, so the location wouldn't seem to me to matter. Having the ability to run assumes not only that you can run, but that you can somehow keep them from catching you. Having your back turned focusing on escape while they are beating you isn't very good defense. That's how I'd interpret SYG. You have a duty to run only if you have a reasonable expectation that you can escape without additional harm.... i.e. they're 20 feet from you and you can get in your home and lock the door.
