A nice solution to the Roy Moore Mess
Someone mentioned this on the Radio...

If Luthor Strange resigns before the election then the Governor can cancel this election to call for a new one. Appoint someone else to sit in the interim and schedule the new election out 60 days.

It would provide times for some of these claims to be more closely examined

And Governor Ivey doesn't want to do anything. Best case scenario for her is for this to just get out of her bailwick. She wants the election to be over, and then this problem is going to be on the US Senate.

On what? If strange resigns you have to replace him now and you can call for another election.

In this case, the person resigning doesn't create an additional vacancy. Strange has already been defeated and cannot even run as a write in (Alabama's 'sore loser' law). His resignation changes nothing about the result of the special election. The courts would probably order the election to go forward as scheduled.

Besides, Gov Ivey would simply just appoint someone for 3 weeks till Dec 12.

And its not going to help Roy Moore either. Nine direct accusations of creepitude, along with all the other people from the Mall.

If Roy was sure of his innocence, he'd be calling for a delay. He's not. I think his plan is to try and hang on, and then convince the Senate that it was all a 'librul' setup. And then run for Governor if the Senate expels him.

Doug Jones doesn't want a delay because that might open up a chance for the GOP to replace Moore as his opponent.

Ivey has specifically rejected this option, saying that if Big Luther wants to resign that's his choice, and she will appoint someone to fill the seat until December 12th.

Yes, it does. The US Senate would only have 99 members sitting and Alabama would have only one. The Governor could appoint a new Senator and call for a new election.

This I believe...

The problem with Luther resigning is that it doesn't change the fact that there will be a new US senator. It does not create a new vacancy. Alabama law specifically demands a vote on open Senate seats because they wanted people to actually have their voice heard on who represents them. Delaying the election would simply lengthen the time period under which Alabama would have an appointed, rather than elected Senator.

The courts would make quick work of such a manoever. Either way, election day in Alabama will be Dec. 12 anyway.
