It’s time to talk about treason.

We now know, according to U.S. officials briefed on intelligence reports cited by the Washington Post, that in early December 2016 Jared Kushner and Russian Ambassador Sergey Kislyak “discussed the possibility of setting up a secret and secure communications channel between Trump’s transition team and the Kremlin, using Russian diplomatic facilities, in an apparent move to shield their pre-inauguration discussions from monitoring.”

At any time in the Cold War, what Kushner did would certainly have attracted the stigma of treachery. Should the same standard apply today?

Let’s consider Kushner’s best defense. Backchannels are an accepted part of diplomatic relations. A relationship may be too controversial for public consumption, and it is useful to have fora where diplomats and those entrusted with the leadership of states can speak frankly, without the glare of the media.

But this appears to have been no ordinary proposal for a backchannel. First and foremost, the intent was to avoid monitoring by the United States’ own intelligence agencies. And second, Trump’s team weren’t in government yet (unless the intent was for the backchannel to continue, or to start, after the inauguration, and thus provide a means to avoid U.S. intelligence monitoring while in office, which would be even more dubious).

The charitable interpretation here is that the Trump transition team did not want the Obama administration to know what they were discussing with Moscow. But this is unpersuasive as a defense, because if those conversations were within the realm of legality, what difference would it have made if the Obama administration knew about them? One might retort that it was important that the outreach to the Russians be kept out of the public domain, and that the Obama administration could have frustrated that by leaking to the press. But this argument is inane, given how publicly Trump advertised his desire for rapprochement with Russia during the campaign.

A final argument might be that Trump’s team was aware that it is illegal for private citizens to conduct diplomacy with a foreign government, so they needed a secret backchannel. Of course, being illegal, the Trump team would never make that argument. They might say, perhaps not unreasonably, that they were not conducting diplomacy, but merely talking to the Russians as an opposition party might do (call it the Marine le Pen argument). But you can’t have it both ways: either the enterprise was legal, in which case there would have been no need to hide it from U.S. intelligence, or it was not.

Let’s be clear. There would be nothing inherently illegitimate with the Trump transition team pursuing better relations between the United States and Russia. Indeed, it was a major part of the campaign platform Trump used to win the election. Foreign policy debate between Russia doves and hawks has been going back and forth since the deterioration of post-Cold War relations following the West’s intervention in Kosovo 1999, and those who want the West to have warmer relations with Russia have many reasonable arguments.

But it’s the very legitimacy of wanting better relations with Russia, given Trump’s democratic mandate to pursue such a course, that makes Kushner’s desire to hide the Trump transition team’s connections with the Kremlin from U.S. intelligence so dubious, especially if he did intend for the backchannel to continue, or to start, after the inauguration. That is the kernel of the illegitimacy here: not the effort to improve relations through a backchannel, but the extraordinary measures to keep it secret from one’s own side.

In the Cold War, Kushner’s actions would have attracted the stigma of treachery because Russia was an enemy of the United States. But his actions would not have gotten him indicted because there was no ongoing open war in accordance with the legal definition of treason (18 U.S. code § 2381): “Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason”.

Similarly today, what we are talking about is not the legal offense of treason but the stigma of treachery — the broader social meaning of treason.

To understand this broader social meaning it helps to think about the history of the concept. In the Roman Republic, there were two treasonable offenses. One was called perduellio, which basically aligns with our current definition of treason of aiding an enemy in war. The other was called the crimen maiestas populi Romani immunutae, known commonly as maiestas, which was the offense of diminishing the majesty of the Roman people. It was only later, after the Republic collapsed and the emperors took over, that maiestas became the offense against the person of the emperor, given how in this kind of monarchy, there was little difference between the sovereign identity of the state and its ruler. (This is the origin of the offense of “lèse majesté” against monarchs still on the statute books in some states today).

If Kushner’s actions should come to attract the stigma of treachery, it would be in the old Roman Republican sense of maiestas, when public values and their expression in state institutions still meant something. Thus, in the Roman Republic, maiestas was about punishing individuals for hijacking their state positions for their personal gain. It could be used, for example, to prosecute official maladministration, like corruption by provincial officials or military officers. An apt modern equivalent would be soliciting personal investments by selling political access or expedited visas to rich Chinese people, which Kushner’s family business has already independently been accused of.

We’ll have to wait for the facts to see what Kushner may have been trying to hide from U.S. intelligence. But my hunch is that far from the “Manchurian Candidate” theories, this will turn out to be a sorry case of operating in the grey areas of the law to enrich oneself whilst in office. Not as bad as aiding the enemy, but still rancid. It is exactly what treachery as maiestas meant in Republican Rome: An offense against the dignity of the state understood as a community bound by its public values.

In Rome, the punishment for maiestas was normally exile. Kushner’s fate is still to be determined. But the public response to it will tell us much about whether the American people, under their new monarch, still have the dignity to protect their ancient majesty.

He is more responsible than anyone for Trump's victory in November. He kept Trump on message and focused on the key states. No surprise the Democrats and anonymous sources would try to take him out. He is extremely competent.

Kushner will be caught in a money laundering scheme. He wanted to hide communications for a reason. That reason was money laundering is my guess.

He logically wants to communicate with the Russians in a non-public manner and you invent some criminal activity.

Why would he need the Russians involved to do money laundering? Trump has a casino.

It is just a deranged fictional monologue by someone in a little bubble talking to other tin foil hat Democrats.

The story about harming America by helping Russia has proven to be absurd, so now the Democrats are inventing some other motivation.

Similarly, reports that Trump son-in-law Jared Kushner suggested opening up covert channels with Russian officials after the election also appear to work against the collusion narrative. The fact that Kushner allegedly explored opening channels of communication with the Russians would imply that such channels didn’t already exist. (Here, too, it’s important to note that no evidence exists that Russia and Kushner actually followed through on the alleged idea.)

Trump’s actions as president are also inconsistent with the idea of a quid-pro-quo. Trump acted more aggressively than Obama in ordering a strike on Russia-allied Syria in retaliation for Syria’s use of chemical weapons on civilians. Recent reports have also indicated that Trump will likely keep in place the sanctions Obama levied against Russia after the election, further undermining the conspiracy theory that Trump is working to advance Russian interests.

Proponents of the collusion conspiracy theory have also routinely ignored the fact that DNC hacking has been traced back to 2015, when Trump was widely believed to have little shot at winning the Republican primary, much less the general election.

If recent history is any indication, however, lack of evidence is unlikely to keep Democrats from pushing conspiracy theories that fit their worldview.

An Economist/YouGov poll earlier this month found that a stunning 55 percent of Democrats say it is “definitely true” or “probably true” that Russia actually tampered with voting tallies to give Trump the victory — an outlandish conspiracy theory with no evidence to support it. What’s more, the number of Democrats who think Russia rigged the voting machines may actually be increasing. The 55 percent figure is up three points from December, when 52 percent of Democrats said they believe Russia tampered with vote tallies to get Trump elected."

If that was fake, why don't you think this is fake? I'm not so sure the e-mail that Comey relied upon was fake. But I can tell you this. He never briefed the Congress, the Judiciary Committee about any fake e-mail.

What he told the Intelligence Committee about this e-mail, he never suggested it was fake. So, if he intervened in the election -- election based on fake information generated by the Russians, that was an incredibly incompetent thing to do. So I don't really know who to believe anymore. "

“I don’t think that anybody at this point is under the impression that a wholesale reset of our relationship is possible at this time, but we might as well test out what they are actually willing to do,” a senior administration official told me. “Our theory of this all along has been, let's see what’s there. Regardless of the likelihood of success.”

Leading the charge has been Secretary of State John Kerry. This fall, Kerry even proposed going to Moscow and meeting with Putin directly. The negotiations over Kerry’s trip got to the point of scheduling, but ultimately were scuttled because there was little prospect of demonstrable progress.

In a separate attempt at outreach, the White House turned to an old friend of Putin’s for help. The White House called on former Secretary of State Henry Kissinger to discuss having him call Putin directly, according to two officials. It’s unclear whether Kissinger actually made the call. The White House and Kissinger both refused to comment for this column.

Kerry has been the point man on dealing with Russia because his close relationship with Russian Foreign Minister Sergei Lavrov represents the last remaining functional diplomatic channel between Washington and Moscow. They meet often, often without any staff members present, and talk on the phone regularly. Obama and Putin, on the other hand, are known to have an intense dislike for each other and very rarely speak.

In several conversations with Lavrov, Kerry has floated an offer to Russia that would pave the way for a partial release of some of the most onerous economic sanctions. Kerry’s conditions included Russia adhering to September's Minsk agreement and ceasing direct military support for the Ukrainian separatists. The issue of Crimea would be set aside for the time being, and some of the initial sanctions that were put in place after Crimea’s annexation would be kept in place.

“We are willing to isolate the issues of Donetsk and Luhansk from the issue of Crimea,” another senior administration official told me, naming two regions in Eastern Ukraine under separatist control. “If there was a settlement on Donetsk and Luhansk, there could be a removal of some sanctions while maintaining sanctions with regard to Crimea. That represents a way forward for Putin.”

Meanwhile, Kerry has been proposing increased U.S.-Russian cooperation on a wide range of international issues. Earlier this month, he invited Lavrov to a last-minute diplomatic confab in Rome to discuss the the Israeli-Palestinian conflict.

After one meeting with Lavrov in Paris in October, Kerry announced that he had discussed potential U.S.-Russian cooperation on Afghanistan, Iran, North Korea, Syria and Yemen. But the apparent warming was overshadowed by Lavrov’s quick denial of Kerry’s claim that Russia had agreed to assist in the U.S.-led coalition against Islamic State in Iraq.

Kerry has seemed more enthusiastic about mending ties with Russia than Obama himself. After the president gave a blistering critique of Russian behavior in a major United Nations speech, saying that “Russian aggression in Europe recalls the days when large nations trampled small ones in pursuit of territorial ambition,” Kerry urged Lavrov to ignore his boss’s remarks, according to Lavrov. “Kerry said we have so many serious things to discuss that of course that was unfortunate, let’s not focus on that,” Lavrov told Russian reporters.

State Department officials insist that Kerry is clear-eyed about the challenges of trying to work with Russia, but that he believes there is no other responsible option than to see what can be accomplished.

“Secretary Kerry is not advocating internally or with Russia for a reset in the relationship, and in fact in meetings he has taken a strong and at times skeptical stance,” one senior State Department official told me. “As the nation's chief diplomat he is simply always exploring ways to make relationships more productive.”

There is also a belief among many both inside the State Department and the White House that sanctions are working. The Russian economy is tanking, albeit due largely to collapsing oil prices and not targeted punishments. One senior administration official argued that absent the sanctions, Putin might have been even more aggressive in Ukraine. Moreover, this official said, the sanctions need time to work and might yet prove to have greater effect on Putin’s decision-making in the months ahead: "We’ll see how they feel as their economy continues to deteriorate and the Ukrainian economy refuses to collapse.”

If the Russians are getting ready to cave, they aren’t showing it. Putin remains defiant and Russian military assistance to the Ukrainian rebels continues. The Russian leadership has been rejecting Kerry’s overtures both in public and private. Diplomatic sources said that Lavrov has refused to even discuss Kerry’s conditions for partial easing of sanctions. And Putin has made a hobby of bashing the U.S. in public remarks.

To many of the administration’s critics, especially Republicans on Capitol Hill, pursuing engagement with Moscow is based on naivety and wishful thinking.

“It’s a strategy worthy in the finest tradition of Neville Chamberlain,” incoming Senate Armed Services Chairman John McCain told me. “I think the Russians are doing fine. Meanwhile, what price has Vladimir Putin paid? Very little.”

The legislative branch has also been active on Russia this year, but its efforts run counter to the administration’s policy and sometimes have the indirect effect of putting more roadblocks in front of the Obama-Kerry push to find a way forward.

On Dec. 18, Obama reluctantly signed a bill authorizing new Russia sanctions and military aid to Ukraine that was overwhelmingly passed by Congress. Afterward, the White House awkwardly said that the legislation did not signify any change in policy.

And this week, the State Department sanctioned four more Russian officials, but not over Ukraine. The officials were added to a list of human rights violators under the Sergei Magnitsky Act of 2012, named after the anti-corruption lawyer who died in a Russian prison. In response, the Russian foreign ministry issued a statement saying that the Magnitsky Act sanctions "place in question the prospects for bilateral cooperation in resolving the situation surrounding the Iranian nuclear program, the Syrian crisis, and other acute international issues."

These latest punishments show that it may be impossible to de-link the problems in the bilateral relationship from the opportunities, as the Obama administration wants to do. They also show that there will always be chances for those in Washington and Moscow who want to stoke the tensions to do so, jeopardizing any progress.

Some experts believe that any plan to warm U.S.-Russian relations is unlikely to succeed because it doesn’t have the full support of either president.

“It’s very clear that between the Putin Kremlin and the Obama White House there is a very bad chemistry. Its not a question of simply distrust, it’s a question of intense dislike between the two leaders,” said Dimitri Simes, president of the Center for the National Interest.

Also, some experts feel, placing the diplomacy in the Kerry-Lavrov channel dooms its outcome, because the Russians know that Kerry himself has no power to make major decisions and Lavrov has to be careful not to be seen as cozying up to the U.S.
