3 Michigan State & 1 staff member suspended due to Sexual Assault investigation
From the article:

The three unnamed Spartans are barred from team activities and have been removed from on-campus housing while the police and the university conduct investigations.

The complaint that is being looked into was brought up in late January.

From Michigan State’s press release:

As part of the criminal investigation, detectives are interviewing members of the coaching staff and other relevant individuals regarding their response since the complaint was made in late January.

Separate from the criminal and Title IX investigations, the university administration is retaining an external law firm to conduct a thorough and independent investigation into football program staff members’ compliance with university policy in connection with the allegations.

One football staff member has been suspended in conjunction with the second investigation into the staff’s compliance with school policy.

one thing is becoming clear in all of these cases at BigTen schools. university adminstrations will act and have the power to suspend or expel students even when no criminal charges have been filed.

the whole nature of due process is different. reports that can help shed light on the decisions university make are all private, which helps create the impresion that they decided without evidence to treat them like they are guilty.

That's happening all over the country (with a few exceptions of course). A lot of attorneys I know are making $$$ representing clients in civil cases against universities for violation of due process rights.

They didn't kick them off the team or out of school. Michigan State took reasonable actions to protect other students. Meanwhile, we complain about schools that don't take action and we complain about schools that do take action.

I think Michigan State did the right thing and applaud them.

They can even kick them out of school in an administrative hearing (lesser burden of proof than criminal trial) prior to the criminal case being resolved and not violate Due Process at all.

This is technically true.


But in light of the ultimate outcome of the Minnesota case recently, I think a discussion is more than warranted over which burden of proof is appropriate for university hearings/panels to use when considering punishment that removes student status (suspension, expulsion).


Put me in the camp who says that a simple preponderance is clearly unacceptable.

There are a variety of reasons that cases dont' end up being prosecuted. I personally think it's a good thing that schools can use discretion when this happens.

Unless schools stat abusing the rule to run off players who are not performing well this is a good thing. Sometimes things happen and although there may not be absolute proof it's obvious that someone was involved in criminal activity there needs to be consequences.

Simply claiming hey I wasn't prosecuted so I didn't' do anything wrong is not the way to look at this stuff IMO.

At the end of the day Universities do not want to kick kids of of school. That's not why they offer scholarships and treat these kids like kings. Kids behavior forces the schools to act.
