Perhaps one of the lawyers here could explain why this would only apply to private colleges and universities, and would exclude publics. How are their athletes any different?

I'm not a proponent of paying players but I do believe the AD budget should give "allowances" to student-athletes for essential needs. As a student-athlete in college myself (at a small D-III school), we were given food and other things quite often. We weren't hurting by any means. Players at large schools are getting at least what we got - I guarantee it.

I'm not a lawyer, but I know the answer. State and local governments can declare who is and who is not an employee and the Feds can't do a damn thing about. The US Constitution precludes the US government from interfering with the states.

It won't happen but it suits me! Nothing would improve Kentucky and North Carolina basketball like Duke having to actually pay its players. Add all of the other private basketball schools to the list and voila, hell even the SEC state school rosters would improve!

But kidding aside, if the privates get their goose cooked on this one, then the state schools will have to take a long gander at their futures as well. One's not getting nailed while the other skates.
