The other guy shot McKnight twice, the second time standing over his prone body.

McKnight was pronounced dead at the scene.

You should probably add "allegedly" shot him a second time standing over his prone body.

I have a hard time believing the police would release a suspect without charges if they had a credible witness willing to testify to that.

Coroner says he was not standing over the body but still, how do you not arrest and charge someone after a killing like that?

You have to remember, the guy had no idea who the person was that got out of the vehicle in traffic and approached his door...perhaps angrily or aggressively. He would have had no idea whether the guy was armed or not.

The state will have to PROVE that he acted recklessly and had an opportunity to remove himself from the situation.

I'm guessing they didn't find it and had no real reason to keep him.

I'm pretty sure every local, state, and federal investigator will give the full length of his colon a thorough examination or two before its over though.
