December 7 At Date that will live in infamy?
As our long football nightmare should end.

Talking to one Club Seater who is a lawyer and said "Perhaps we could do a class action suit to break our 3 year commitment"

Sign me up. To me it is breech of contract. I paid for football - I got a petulant child.

Well, at least year 3 will, in all likelihood, be without Tubs

I'm sure Rath has already subpoenaed every caddy at Kenwood Country Cub.

Coldstream with hand warmers likely today. Winter rules. Gets to bump it in the fairway.

He got his kings ransom weekly paycheck yesterday and is due a $200k retention bonus on December 1st. Life ain't bad.

Last I heard the powers that be were torn on what to do with TT. Of course, the obvious answer is to can his worthless @$$ but apparently it's not obvious enough

Well, nothing will live in infamy on that date compared to 1941. From Bearcat Nation perspective, however, it will be a "Bad Day at Black Rock" if Tommy Slothville is not given his walking papers on or immediately after that date. Year 5? I don't even want to think about it.

RE: December 7 At Date that will live in infamy?
If Tommy is retained I think one Club Seat Strategy will be just don't pay and let UC sue us. I just got out the contract and it says nothing specific about no payment or breach remedies. There is a section titled "Payment Schedule" which simply has June 30 of each year.

There are two remedies for breach of contract (1) Money and (2) Specific Performance.

Specific Performance is only enforced when money does not make the breached party whole.

Thus UC will have to sue each Club Seater in court for monetary damages and legal costs. That will be great publicity for UC.

I will not believe it until I hear Bohn say, "It was decided that it was in the mutual self-interest of both UC and Tommy Tuberville that he not remain as our head football coach and both parties have decided to pursue other options."

I think you're going to hear nothing but crickets on the 8th, however.

By-the-way, regarding your "Club Seats," I'm no lawyer, but...Caveat Emptor applies here, I think. The University delivered on the seats...they have no guarantee of the quality of the product on the field. So enjoy your Champaign and caviar...

We all know such a suit would not prevail and would be quickly dismissed. The purpose is just to shame. The contract does not make any promises of performance.

Actually the date is December 8th. Contract states it had to be after 12/7

I thought it stated he couldn't be fired before Dec 7? They could fire him Dec 7 in that case.

Wouldn't the shame be on you for trying to renege on your commitment/contract with UC?

I heard we were looking at an ex-Illini to replace Bohn if he doesn't cut the mustard. Let the circle be unbroken!
